  • help with ppi please RBS credit cards/mortgage

I wonder whether anyone could assist me, I have only just discovered that I have PPI on a number of credit cards and a mortgage. I honestly didn't believe I had PPI and as such had never looked into claiming any charges beforehand as I believed it would be futile. However my partner pestered me to at least look into it if for no other reason than to keep him quiet!
So I looked up the best way to ascertain whether I had PPI and after obtaining details of all my credit agreements from Equifax I contacted the companies direct and enquired whether PPI was in place. Upon contacting RBS who I bank with I was informed I had PPI on 2 loans, an overdraft and a mortgage. Further enquiries revealed I have it on a number of other credit cards. (All pre 2007) I was completely shell shocked as I didn't think I would have taken out the policies.
The reason for this is that I don't believe I would have needed the cover. I have been in full time employment with my present employers for over 20 years, my employment is very secure and as such I would have never been tempted by the redundancy aspect of the PPI. Insofar as sickness/accident cover is concerned my employers have always been very generous in respect of this and have always paid sickness in full over the years. They have in fact paid sickness out to two of my colleagues, both of whom unfortunately died as a result of their illness and as far as I am aware full pay was paid out up until their death. As such I would never have been persuaded by the sickness/accident element. As I do not recall taking out PPI (indeed I was convinced I did not have this) I am unable to provide any information in respect of the selling process. All I can say is given the above facts I know I would not have been interested in taking the cover. The only reason I can conclude I would have therefore taken the cover is if I believed it was compulsory in obtaining the credit. Also would I need to prove I had this cover in place with work? If so, what proof would be acceptable? My contract of employment has changed over the years and with the recession my employers are no longer generous with regards to sickness etc. I am sure they would be willing to confirm this in writing if required. The changes in my contract of employment and sickness payout etc is post taking any of the credit agreements out.
It should also be noted that I have long standing pre existing medical conditions - asthma and depression. I don't know whether the policy would have paid out as again I didn't know I had it so am unaware of the t&c's but would this be of any relevance to claiming I was mis sold. I have had time off in relation to both of these conditions but could not say when without speaking to my Doctor. However they have not been long periods of time in any event. Do I need to refer to this when completing my questionnaire or is it irrelevant.
Finally insofar as the Mortgage PPI having read the various posts I am aware payout for mis selling this product is pretty much none existent. Again my grounds for claiming I was mis sold would be along the same lines as above. In the event PPI was a requirement of my mortgage then I know I would have done some research on alternative providers (I always shop around for the best deal) and had I done this in relation to my mortgage I would most definitely recall doing so, especially as it is such a big financial commitment, so again I can only conclude the only reason I would have taken PPI on my mortgage with the RBS is if I was told it was compulsory.
Could anyone advise me what are the chances of success in relation to my claims on credit card/overdraft/mortgage and how to complete the forms if I am unable to recall the selling of the policies in the first instance. Many thanks.

    Re: help with ppi please

    Hi Scout77
When i first discovered that i had PPI on numerous accouts, the same as your self. I asked for a Subject access requeas (SAR) (you can access a tenplate letter on this site) from each company involed, you will need to send a cheque or postal order for £10.0. They will then forward all the information they have of you regarding these account. I would send the request by recorded delivery.
    Good Look

Re: help with ppi please RBS credit cards/mortgage

Thanks Gill. Would it be necessary for me to go down this route if they have already confirmed I have paid ppi? RBS have been very helpful and even confirmed periods I have paid ppi on the credit cards and mortgage. Due to the time lapse in taking out the products I genuinely do not recall the sale of the ppi I just don't believe it would have been of any value to me given my employment status/medical condition and can therefore only assume that had I been fully advised about the product/limitations/fact it was optional etc I would have declined the product. Presumably the ppi payments would have appeared on my credit card statements and if I have allowed the payments to continue it must havebeen because I believed they had to it.
Soeven if I applied for full details on these accounts I doubt I would be able to argue my point any better and wondered whether therefore the bank is likely to find in my favour or am I wasting my time as I can not recall the way in which the policy was sold to me?

Defimatley not wasting your time... if you have the credit aggementts for your loans...your are able to roughly calculate the redress. same as the statments for you credit card,,,requesting a SAR, all of your statments will show amounts taken out. Dont forget you need to also claim back the interst.

Re: help with ppi please RBS credit cards/mortgage

          Hi Scott

As Gillwall says you definately stand a chance like everyone else, they MUST take into account what you tell them and the fact that you are with the same employer as well helps if this is the case, because I'm sure your able to get confirmation on what your employer would cover you for, sickness etc.

And in regards of pre-existing health conditions, its not likely they would pay out on that particular condition, so yes worthless to you.

You do appear to have good grounds here, so give a go.

In regards of the mortgage, apart from the cover they applied to your mortgage, did you also have another in place to protect it as well? Just double checking on this, because having cover elsewhere already in place at the time you were sold the ppi, there would not have been need for another cover.

If you requre a Subject Access Request (SAR) template, let us know and we will post up a template here to request your information on your accounts.
There is a cost of £10 per business (not account as that would be costly), so if you had so many loans/credit cards with the same business, then one SAR and one payment of £10 cheque or postal order covers it all, you just apply all the account numbers that apply, however if the accounts were taken out with your own bank, if you apply your banking account number, that should therefore cover for all the info you require on all accounts you held with them.

If you do not have a credit agreement, you can request for this for just a £1 cheque or postal order per each agreement, ask that they provide you with this by 12 days this will enclose details of your loan amount and ppi etc, also terms and conds.

The SAR request if you do this takes up to 40 calendar days x
