    Ti be honest it is not that clear. May be somebody will understand it better than me.
    However, the way I see it (may be a wrong way is that The FOS is in the process to establish a precedent dealing with the current case they mentioned to you.
    There is a hope.
    Unfortubately what appears logical to us sometime is not supported by law and regulations. Those cases with establishing connections seem to be the weakest any grey area.
    The FOS is having currently a case which might bring more clarity and will make it easier for future similar cases if the outcome is in the favour of the customer.

      Well lets hope something positive comes out as it was FOS that advised me that Underwriters could possibly be responsible for mis-sale.

      Yet again like you say this is a grey area but it needs to be looked at and I have recently discussed this issue with the adjudicator on another similar case, who assured me it is something that's being looked at or taken into consideration.

      It's all very well that regulated Underwriters / Lenders taking premiums / commissions but denying any part of mis-selling by broker etc who is not regulated.

      I will keep you posted on any further developments but I have just got to wait and see.

        We just have to wait and hope. With this case not much else we can do at the moment.


        I communicated with the FOS with general feedback (not a particular case) and they are aware about that grey area underwriters/agents/businesses etc.
        They are trying to find solutions to establish the way to look at such cases.
        They are working on it.
        I know it is not much help, but they are trying to sort out that "grey" area.
        I shall wait for your update.

          Well can only hope that they address the issue favourably for the consumer as it seems to be certain banks get out clause for any responsibility and when onus put onto regulated Underwriters, they deny any part of sale of insurance.

          I will keep you posted.

              Is there any further updates with this claim, I have tried twice to claim ppi back from Next. In a letter I received from them, they did admit to adding the PPI without sharing with their customers. However they did not see a problem with this as they did not have the same responsibility as banks so that it was not their problem:tinysmile_cry_t:

                Hello I wrote to Next originally in January 2015 about PPI - they dismissed my claim. I wrote again in January 2016, they initially dismissed it, but i then received a further detailed response in February 2016 with the same contents of Bazza's post on 10 March 2014 pointing the finger at First Assist.

                I was just wondering if anyone had an update since the last post on 21 August 2015, as i'm not sure whether to send the Ombudsman's template form (downloaded from Moneysaving expert) to Next or First Assist.

                  You are wasting your time with First Assist. You need to send this to the original underwriters who have responsibility for these Next complaints.
                  Send your complaint to Phoenix Group,1 Wythall Green Way, Wythall, Birmingham B47 6WG. 0203 7350550 , 01564 828823

                  If you actually had PPI then you will get a guaranteed payout from Phoenix because Next automatically added the PPI to the older accounts - you had to call them to cancel it - instant mis-sale.

                  Good Luck - we take from the greedy and give back to the needy!

                    Did you send Next a Subject Access Request ?

                    Or do you already have PPI details / statements ?

                    Next actually sent me a statement of account with totals proving that I had paid insurance.

                    My original complaint escalated to the Financial Ombudsman and out of the blue, Underwriters contacted me again even after previously denying my complaint with an offer.

                    So if you have proof of PPI, I would be submitting a complaint to Phoenix Group.
