Re: PPI claims for EGG CC/Loan and Capital one cc

Ok this is the email I have come up with for Barclays. I have attached the hospital letter and an updated claim form. I had forgot to mention my telephone call to Egg. so I have also added this too.

    Good Afternoon,

I am writing to you in reference to my ongoing claim in regards to an Egg credit card that I took out in Oct 2003 and closed in Sept 2005.

I have found a hospital letter dated may 2013 which shows that in regards to my medical condition of Hidradenitis Suppurativa my symptoms began 10years before that date. I have also updated my claim form with the new information as this shows I was unable to make a claim and was misadvised. No questions about my medical history were asked. Also I as my claim states I was mislead into believing that taking out the insurance was important for my aceeptence and without it my application would be rejected. The application also included a pre ticked box. Everything about the insurance was incorrect and if I had been given the correct information like exclusions and limitations, if the box hadn't been pre ticked or had I not been given false information about what affect the insurance would have on my application I would not have taken it out as I wasn't suitable due to my health and that I had all the means to make payments anyway.

I understand that a Blaise Samuel Jude Johnson the Customer Relationship Manager is investigating and dealing with my complaint. If you would be so kind to pass this email and the attached documents to the relevant department I would be grateful.

Sorry for not getting back sooner, I had visitors that turned up unexpectedly lol, as the form confirms in black and white that you would not be covered for pre existing conditions, that with the proof of your hospital letter they must take into account.

Great email you sent as well.:tinysmile_twink_t2:

I have some good news. My claim for my Egg Loan was upheld. That has got to be the quickest in history I'm sure :tinysmile_twink_t2::tinysmile_twink_t2::tinysmile _twink_t2::tinysmile_twink_t2:! They said that £2034 is my total minus tax equals £1969.16. Now they want to pay the debt collection agency £756.09 so I will only get back £1213.07. I didn't think they could do that if the debt has been sold?

Well done on your success!! YAY!!:tinysmile_twink_t2:

Was it fully assigned to the DCA who taken over it, where the original business have had no contact with you at all since the debt was sold on?
Do you mind saying who they are please? thanks x

Re: PPI claims for EGG CC/Loan and Capital one cc

Hi yes I believe so. i looked into my credit file and Egg/Prudential Group entry states that the loan was taken out in 2005 it then shows as settled in 2005. There is then another entry from Arrow Global stating that from July 2011 its in default. I also spoke to arrow global yesterday and confirmed that they do own the debt outright, No the only contact I have had has been with Global Arrow and firms acting on their behalf. I sent an email to Ian Clark who made the offer from Canada Square saying that I don't think the amount offered is correct. I went by his figures and by what the FOS state that the redress should be. I included the link to show the FOS webpage.

I worked out that the redress they offered was around £300 less that it should've been. Workings out should be like this
1st part is the difference between what should have been sold to the DCA without PPI and what was sold. Then 8% interest per year from date of assignment to the complaint date. 2nd part is the premiums paid plus the loan apr interest rate then 8% per year from the policy start date to the date loan was sold. I have also question the rebate they say I got as I never received any cheque nor was it ever deducted from the loan. I have asked them to show me where it came from.

In regards to the £756 that they was to send to the DCA they say that its to restructure the loan as per the FSA regulations but the FSA handbook also states the following ' (1) for live policies:
                (a) subject to DISP App 3.7.5 E, where there remains an outstanding loan balance, the firm should, where possible, arrange for the loan to be restructured (without charge to the complainant but using any applicable cancellation value) with the effect of:
                (i) removing amounts relating to the payment protection contract (including any interest and charges); and
(ii) ensuring the number and amounts of any future repayments (including any interest and charges) are the same as would have applied if the complainant had taken the loan without the payment protection contract; or
                (b) where the firm is not able to arrange for the loan to be restructured (e.g. because the loan is provided by a separate firm), it should pay the complainant an amount equal to the difference between the actual loan balance and what the loan balance would have been if the payment protection contract (including any interest and charges) had not been added, deducting the current cancellation value. The firm should offer to pay any charges incurred if the complainant uses this amount to reduce his loan balance;' Now I am sure that as I don't owe Egg/Canada square anymore they have to give me the full amount. They can buy it back but do you think they would after they have got their money back and any tax relief from it.

Re: PPI claims for EGG CC/Loan and Capital one cc

UPDATE: I decide to accept the offer. They gave me all the calculations of their working out and I figure that sending the DCA £756 will get them to back off a bit ! Also they're sending me the cheque for over £1200 and I can do a lot of Debt rearranging with that. I have another 4 that I'm waiting on answers so fingers crossed on those. I have also put in a claim to get back all my Advantage Gold Account Fees from 2001. It was sold in the branch and they didn't give me any option of the free accounts available nor did I receive any T&Cs for the Mobile insurance and I also wouldn't have been able to use the Breakdown cover as I didn't and never have had a licence. I'm hoping that I will here from them too!

Good luck in all your claim battles and thanks for your help!
