    Hi Everyone,


    I have put in 2 claims for Egg and I have since found that I also had a Capital One card that had PPI too. After going through all my papers I have come acrossed a hospital letter from May 2013. Within the letter it states that I have had a condition known as Hidradenitis Suppurativa since May 2003. It has only been since 2012 that I had a diagnosis but I was having symptoms since 2003.

    I have already sent off 2 claims for Egg both stating that they were pre ticked boxes and that I was told that it would greatly improve my application to take out PPI. Now on these I have my terms and conditions and within it states that I am not covered for 'Pre existing medical conditions' Egg never asked me about my medical history or suitability. I can see that I wouldn't have been covered for HS which has been ongoing throughout. When I took out the policy I was told that PPI was a major factor for acceptance and I wouldn't have known that I had a condition as I had only a few abcess' and was told that it was a skin infection. In 2011 I was then told that they were reoccurring Abcess' and finally in 2012 I had a diagnosis.


    In regards to Capital One. I rang them as I had an account in Oct 2003 - Feb 2008 and to check if I had PPI (I don't have any paperwork) and was told that I did. I was talking about it with my Dad and he remembers that he actually helped me with the online application. He remembers it because it made him open one also. He remembers that the box was also pre ticked as with Egg and he was also shocked when I said that it was optional. We were under a reasonable impression that it was not optional. I received only a summary of the PPI with Capital but never a full policy explaining the exclusions. (Capital One were actually fined by FSA for that in 2005) I had read other posts and it seems they still deny this happens. Now I am unsure about the card activation because I am sure that it was done with an automated service but by posts it shows that capital one say that this is were most sales take place. I am 100% certain as is my father that I left the box ticked . I had applied with Egg the same month and was told that PPI a major factor in the acceptance. So with this in mind, the pre tick box and no information to suggest otherwise.


    With both of these agreements would my illness have been considered to have been pre existing? noting that I had only one outbreak during between may and dec 03. Egg did sent me my T&C but I was told that my application would be rejected. I was also under that same impression with capital One except I didn't get any in detail policy from them.


    Any help would be appreciated!

    Hi and welcome

    Having pre-md conditions at the time it was taken out then the policy would not cover you if you made a claim due to those medical reasons.

    It can be more difficult to be successful on ppi reclaims if applications were completed online, but there's still been a high number of success, depending on your full reasons.

    It appears that like with many the application was pre-ticked then assumed it part of the application, it's also been known that if its been unticked the application would not allow to go any further, it would fail to go through if you get my drift, so with that customers assumed it must be all part of the package and to be accepted for credit.

    So when you say you made 2 claims, do you mean you have put in a reclaiming complaint (not a claim on sickness etc)?

    If you have already made a start on the reclaim, have you had any feedback from them yet?

      I have already made to reclaims to Egg Loan/Canada Square and EGG CC/Barclaycard. I am in the process now of submitting my claim to Capitalone cc. On the Egg claims I haven't mentioned about the illness as I didn't have the letter and wasn't sure of the dates or years so I based my claim on the pre ticked boxes that were present and also that it was told to me that my application would be rejected. Now since I have found the letter this does show that I have had symptoms from may 2003 but was unaware of the condition itself. The problem I have now is with EGG claims should I also put in that. I do have terms and conditions but it just says 'a pre medical condition' it doesn't state what the definition is or meaning. I haven't got my term or conditions of the loan PPI but I can take a guess and say that it is the same.


      With CapitalOne I have listed the reason for my complaint as 1.Pre ticked box and no explanation of opting out or of the policy itself was optional. 2. I never received full terms and conditions in relation to my policy only very brief summary which on that alone I couldn't have made an inform decision. 3. what that without the terms and conditions and exlusions in any detail I would not have been able to understand fully what a pre existing medical condition is or if my constituted as such. I also made it clear that I still didn't know to this day! I have made it clear to capitalone that I never had a diagnosis and that I was unawre that they were required by Law to send me my full policy with terms and conditions. They always try to argue that its an unadvisory sale or that the box was not pre ticked and also that t&c summary does have all the information. Not by my recollection and by the FSA who fined them lol

      I will send my hospital letter as proof but I am not sure that I want any of the companies to pry too much into my medical issues as they are one going and The policy with all has already been cancelled so I am hoping that the hospital letter with my condition and 10years given as timing will be enough. No reponses yet only the normal looking into it and that they have 8 weeks.

      Do you think I should add to the claims already made with EGG? Also do you think my claims are strong enough with Cap One. Ive heard they can be really tough and that the FOS rarely upholds against them.

        Hi, sorry for the delay, I was scanning my computer.:tinysmile_twink_t2:

        Basically you still have a good chance, but any information you forward they "must take into account", the fact that you did not have the official diagnosis until recent years but still had these records on the Dr's files when you taken out the policy, if a claim was to be made, its possible the insurance company may have tried contacting your GP for evidence.
        Saying that, if you were to make a claim for ie: sickness now they may have still refused paying out if they did go to the GP for this evidence where it may have come up that you had that problem then.

        May I also ask if you may have other reasons that may apply to you? (you may be able to add whatever further to the complaint), like if you were employed full time at the time it was taken out, did your employer cover you for sickness? If so then do let them know that, as there would be no point in making the claim to the bank/business if already cover in place.
        Or:
        If unemployed or worked less than 18 or 16 hours with some, the cover would probably not have protected you either, so add all that applies to you.

        I would see what they come back with, if they reject, we can try pushing further with their CEO (Chief Executive Officer) if the complaints dept does not allow you to write further to them, as its been known making the move on the CEO dept can often overturn rejected decisions.

        Then if it still fails with the CEO, you should have the eligibility to complain to the Financial ombudsman service (FOS).

          I was in full time work and had been for over a year and a half. Funnily enough I was a customer service advisor for currys and dixons mastercare warranty lol. Yes I did on the form it asked if I had ever made a claim due to my pre existing condition I put no because my work benefits covered any sickness. I understand that from an insurers stand point they would contact my GP and they would have seen it there. Do you think the letter will hold much weight in showing that I was effected by limitations? Ill attach it for you now.

            Definately forward them the copy of your letter, I feel it may help and strengthen your case, they cant get better proof than that in my opinion.:tinysmile_twink_t2:

                Good luck, please keep me posted.
                Hopefully all will be straight forward, but if they do not uphold in your favour, sometimes they give you another opportunity to forward further info, but if they do not and they provide you with a final decision and enclose details of the FOS (Leaflet) you have 6 months from that date on the final letter to complain to the FOS.

                But what we will do before that is request for the CEO to review by 14 days.

                Hoping for a good outcome on this but do not worry if its not the decision you do not want to hear, because as said above there are other avenues we can go with these.

                      Thanks I will do now. I remember seeing in a post email addresses for financial businesses but cant find it now . If I get to them by email then I am hoping that it wont slow things down too much.

                          Sorry just one other question. I have sent off an email with the letter to Canada Square stating that the policy was wrong for me. But I have my credit agreement with Barclays and in it only says 'pre medical conditions' nothing else. Not sure how to go about the email?
