  • Should i try and claim ?

    Hi all i have been looking into this and got confused so i was hoping you could clarify some things for me

    First of all im going very far back ie over 10 years so my memory isnt to great on what i took out with who

    After leaving school i was working then i started my own business

    my credit was good and i had a loan with natwest i think and repaid all of that

    I then got a barclaycard and capital onecard - now i think i was working when i got one and selfemployed when i got the other

    I also got a personal loan off barclays

    Unfortunately my business ran into trouble and this led to my finances becoming a mess

    I got a CCJ for the loan and was chased for years from various different DCA as my debts i believe were sold on - funny enough i never herd of the CCJ debt last

    All of which are now over 6 years

    Now i understand if i claim it may get offset against any out standing debits

    My question is the credit cards i had been making payments on for some time and also the loan - i dont know if it would be higher than the outstanding amounts -

    I have some paper work for the 2 CC and i think i could get info from the courts in regards to the loan

    Would i be best asking for what information the lenders have befor trying to start a claim >?

    can i effect the fact they are now spent ? as i dont want to cause more problems if it was to cause more issues id rather let sleeping dogs lye

    Hi and welcome

    Hopefully someone will clarify on this but if your debt was fully assigned (sold on fully with all liabilities) its known the refund should come back to you, but it varies and I am not certain when a CCJ comes into it.

    If its not under a CCJ but with a Debt collections agency (DCA), you have the right to reclaim on the PPI as its not any use to you now anyway and have not been since you were not able to pay the full amount that included the ppi.

    Many here have been successful with making ppi reclaims from years ago, a few of mine was from the mid 90's and succeeded.

    So do you have any not under CCJ?

      hi i have the credit cards which were not under a CCJ

      also have one from either tsb or natwest that i paid in full but i cant remember which one when etc and have no paper work

        I can help you in regards of the non CCJ reclaims and if anyone else comes along who have experience of reclaims whilst under CCJ, they can explain the procedures on that one for you.

        So with the credit cards are these both with TSB and Natwest?
        Not that this is a problem, but how long ago approx were these paid off?
