Bmw pre 2005 ppi policies- fobbed off?

  • Bmw pre 2005 ppi policies- fobbed off?

    Hello everyone.
    started 2 separate ppi claims against bmw financial services.
    sent off complaint forms for both policies, received the following letter back for both:
    "thankyou for your letter/form received @@@@@.
    You did purchase a payment protection policy.
    the agreement commenced prior to 2005, this is prior to financial services authority regulations and therefore we are not responsible for the sale of insurance policies. (They received the money though??)
    you therefore need to address any concerns about the sale of the policy/'insurance' to the dealership directly.
    you should also be aware that you at not have the right to refer this to the Financial Ombudsman Service"

    questions to to people more in the know:
    1:do I write back to bmw? If so, what would be the best way to word this?
    2:do I write to the dealership as 'advised' to?
    3:I am aware that people have had success against the underwriters of ppi policies, I know the underwriter for the later policy (2004) but I'm not sure of the Underwriter of the first policy which was from 1999, I have read a couple of references to London General Insurance..?
    can anyone confirm this?
    apologies for the long winded-ness of this all, but I want to present the strongest case to enable a resolution to this matter, any forms I advice/help or if anyone else is having an issue with Bmw please get in touch.

    Hi and welcome

    Usually whoever set up and sold the policy you pursue them for the complaint. (Sometimes it can be set up for you, but once completed its send to the bank to whoever takes the monthly payments) but if BMW directly sold this to you, it should be them you pursue.

    If it was the dealership who set this up, its them you pursue.

    If the actual business were not regulated by for example FSA or GISC prior to Jan 2005, the FOS usually suggest going the underwriter avenue, as its likely they would have been regulated as for being the business and underwriting the insurance. You can find out from whoever set this up who your underwriter was as it may differ from one to another with others.
