  • RBS PPI - Unsuccessful claim

    Hi everyone.

    I've recently been through the process of trying to reclaim my PPI back from my Credit Card which was taken out in 1996 with Natwest.
    RBS have come back to me and rejected my claim (no surprise there I guess).

    They have informed me that:
    PPI was sold on a 'non-advised' basis at that time and that the staff member was required to have brought the benefits and key features to my attention. - Don't remember that.
    I admittedly completed a form and signed the box stating that I wished to accept the PPI (I fillled in the form in branch and don't remember being told a lot about other that to sign there, there and there). They have implied that I would have been given sufficient information to make an informed decision. I don't think that's the case as being sat in an office completing a form doesn't give you a huge amount of time to review and I can't be alone in being given stuff and not reading it at the age of 23?

    They freely admit that that I ought to have had the features explained to me, and should have been asked enough questions to vaildate my suitablity, yet they have rejected my claim, and seem to be stuck with the fact that I was given a booklet to read that gave me the right to cancel after 14 days if I didn't feel I needed it.

    Has anyone been through this?
    Is it worth talking to the FOS?

    RBS, are talking out of the back of their head...
    There were no Benefits & Needs in 1996 or;
    Key Features.
    However, if you filled the form out in a NatWest branch, then the sale would be considered as: advised

      I agree with AC from word to word, I would write back, or even write to the CEO of the bank with what AC states too.

        Thanks for this both.
        I think writing to the CEO is possibly a good start then in that case.
        Not being the most proficient of complaint letter writers, does anyone have a base template I could use to begin with?

          Hi Steve

          Basically you need to write a letter by just telling them that you are disappointed with the outcome of your Credit Card Payment Protection Complaint, and do not agree with the findings they made,with that you wish to ask them to review, because you strongly believe you have a genuine reason to make a complaint and make a reclaim on your PPI.

          Firstly, may I ask if they have given you the opportunity to write back further?
          If so is there anything you could add to the complaint that you may have missed perhaps?
          Such a pre-med condition?
          Was you already covered elsewhere or by your employer?
          Was you working more than 16 or 18 hours per week?

            They've basically pointed me in the direction of the FOS, didn't see anything where it gave me the opportunity to write back.
            Didn't have any medical conditions, and as far as cover by employer goes, there is a chance that I was but its nearly 17 years ago and I've changed job 3 times since then, all of which would have covered me for sickness.
            Certainly was working more than 16 hours per week as well, but they are aware of that. Does it make a difference?

              Hi Steve

              Yes if working less than 16, or 18 weeks with some, they do not normally pay out on part time hours.

              You also said that you were covered by your employer anyway, so with that you would have still been paid for the sickness side of it, where the PPi also gave that. Many have made a reclaim on the basis they were already protected by their employer.

              You can of course continue with the FOS if you want to, what some do, if they are not certain if the complaints team have confirmed they will look into further to review or not, some have tried raising their concerns with the bank/business Chief Executive Officer (CEO) first by giving no more than 14 days, and if no decision changed in your favour, move on to the FOS, as you have to do this by 6 months as from the final decision, the final decision should enclose leaflet details of how to complain to the FOS (I take it they did enclose that particular leaflet)?

                Thanks Di, yes they did include the leaflet. That's why I was going to take it up with the FOS.
                Didn't have any details as to how to write back to complain to the CEO so will pursue that route first I think.
