      I think they are all as bad quite possibly but yes from my limited experience with Barclays they seem to be coming out tops for being the worst!

      Anyway I have just had another reply, this one on behalf of the CEO - from one of his slaves! It is a rejection again - last two paragraphs as follows:

      "Our records show that the application form you completed was a postal application form. This means that PPI was not recommended or taken on the advice of Barclaycard but of your own choosing. The application form clearly offers you the choice to either take PPI cover by ticking the "yes" box. You have ticked the "yes" box. There was no requirement for you to take PPI cover, nor would taking PPI cover assist in your credit card application.

      As a result Barclaycard cannot be held responsible if a customer had existing or alternative cover already in place (private or via the employer) and duplicated cover by opting to take PPI cover. A postal application leaves the decision as to whether or not to take PPI cover with the customer after they have determined whether their circumstances warrant the need for PPI cover. We must therefore advise you that our decision will remain the same".

      So my friends, any suggestions as to how I can now proceed before going to the FOS who I believe are now taking 12/18 months for claims, which the banks obviously know.

      The thing is in one of my letters to them I also pointed out I spoke to someone on the phone at the time of completion of the form and was coerced into taking the PPI. I think even if I ask for a copy of the form this is somewhat irrelevant under the circumstances.

      Yes the box was ticked but that is the point. Everyone who is and has claimed PPI had the box ticked at some point surely otherwise we would not all be claiming PPI back!

      I have also in one of my letters sent the FSA Rules etc., this all seems to be to no avail.

      Your help and suggestions as to what else I should write before going to the FOS would be greatly appreciated as always.

      Recently I've had no hassle with RBS(MINT) and also Capital One, albeit the sums will go towards reducing my debt.

          Clearly, you are unlikely to get anywhere with Sharkleys;
          you could have one last ditch attempt, I suppose?

          Now you need to do an information gathering exercise; make a FULL SAR which costs £10.
          And while you are waiting for that information, get your complaint off to the FOS ASAP; the backlog with FOS is approximately up to 2 years. But, at least they (FOS) have some chance of getting Sharkleys to pass the comprehension test, maybe?

                Ha ha yes, sorry it's me, brain not in gear, they are doing my head in! Just wondering if there were anymore rules and regs I could throw at them before going to the FOS? Think I might write to the Chairman also first, doubt will do any good but they do seem to have a very standard set of letters for rejection who ever you write to.

                Of course I ticked the flippin box, I was coerced into doing just that somewhere along the line! OMG this is so so frustrating !

                  So many of us just ticked the box or, signed in the box and;
                  many of us thought that we had to have the PPI (the Banks bread & Butter) in order to obtain the credit card or loan.
                  Furthermore, most of us didn't understand the Cover or, how it was limited via the ingeniously written "Exclusion & Limitation" clauses, which were designed to mislead...!

                  Yes, it is frustrating but keep going; keep bashing away; never give in!

                      Can anyone tell me the correct address to send the SAR to for Barclays please? I just telephoned their offices and basically the switchboard operator gave me the Canary Wharf London address. However, she actually admitted to me that she didn't actually know what a SAR was so who knows if this is the correct address? OMG I just cannot believe this - tearing hair out!!

                          Well after loads of letters to the CEO/Chairman/Uncle Tom Cobbly and all, Barclaycard are still rejecting my claim. Looks like it's to the FOS I have to go! Ah well, it will be done! Just a lot more flipping paperwork and waiting.

                            Well, a bit of a bolt out of the blue…. A letter from Barclaycard arrived in the post this very morning saying……"your case has now been passed to me for further investigation and I will respond with a final response shortly!" This was signed by yet another Customer Relationship Manager!

                            Ho hum, will wait and see what happens - yet again!

                              Well, I am pleased to report some good news! After receiving their letter saying they were going to reinvestigate, which of course I acknowledged thanking them and also politely reminding them that they would incur costs if I went to the FOS…..lo and behold a day or so before Christmas I received a letter from them saying they were upholding my claim!!

                              They will now provide me with a refund of just over £2K. This is despite the fact that I had made a claim (this I had completely forgotten about!) and as a result this will be deduced, fair enough - though this still leaves me with just over £2K. I actually phoned them to make sure I was reading the letter correctly and yes I was. I was also told that the cheque was in the process of being printed and I would receive it shortly! (It hasn't arrived as yet prob due to the Xmas/New Year post).

                              Now the point is, I am obviously a very happy bunny as I had completely forgotten I had made a claim and if I had remembered I probably would not have bothered writing to them in the first place! Sometimes, I guess it serves to have a bad memory!

                              So my friends, this leads me to ask the following question:

                              I had a loan with Cahoot in about 2004. The only paperwork I have is a few letters with the loan reference. Now I do remember on this one I did make a claim on the PPI albeit towards the end of the loan which was then nearly paid off.

                              I have not made a PPI claim with them as I automatically thought that if I had made a claim I wouldn't get anywhere. However, Barclaycard are paying up even though I did make a claim (which having gone through more paperwork, I see that I did).

                              Do you think therefore I have a chance of a successful claim with Cahoot? The same applies to a MBNA card, though this is on my debt management plan and I probably wouldn't get anything other than to reduce my debt.

                              I was just automatically assuming if claims had been made with PPI then you couldn't claim it was mis-sold.

                              Your thoughts and comments appreciated as always and all the very best for 2014. Onwards and upwards for all those that are owed money from PPI - do not give up!!
