  • PPI Claim post divorce - ex will not agree to sign

    Just wondered if anyone had any experience of a PPI claim on a secured loan post-divorce.

    Quick background - took out a secured loan with then-spouse to consolidate some debts.
    Spouse left and I was left to pay the loan repayments.

    There was £10k of PPI on the loan which it turns out we really didn't need. However ex is refusing to take part in a claim with me, as ex wants to go via a claims company who will take a big old chunk for themselves.

    I have paid every single loan payment since day one. I'd rather ex didn't get any of the money tbh, but at the moment neither of us is getting anything!

    Any way I can part-claim or, if I can show I have made all the payments, that I can claim alone, or have I no chance if ex won't sign the claim (as ex co-signed the application for the loan in the first place, despite me getting lumbered with it in the divorce)?

Gosh its common sense for ex wife to agree with you, I rather let ex get half of the £10.000 which she is entitled to if its a joint loan in both your names than claims company getting a huge chunk or you getting nothing. SO SO frustrating otherwise. Why on earth give claims company money for something you both could easily do your selves. Gosh what is she afraid off, you running off with all the money, you cant as loan sounds like its in both names whether or not you paid the monthly premiums by your self.
