    Have just sent a prelim to creation finance for the mis-selling of accident/death insurance policies on a old account I had with them. I was really shocked when I look at the info they gave me with the SAR, They applied about £21 a month for these ridiculous stupid policies.

    No credit agreement sent.

    Let see what they come back with. Come to about £1,200 with contractual interest at their monthly service charge:carrot:

      Sorry but it has been a while since I was here, but I thought it would be nice to update this thread.

      Bit of a story, no more than you would expect from me as nothing seems to run smooth with these cases.

      Ok approached cf re insurancces, well they were very rude indeed:tinysmile_cry_t: and told me it was nothing to do with them Gave me the address of the insurance company, who I contact very nicely and asked them if they had any info, They did, and they gave me a little, wrote back again questions and they gave me a bit more info, but they appeared to be contradicting themselves somewhat. Ok then I sent the SAR, oh and what a can or worms was opened, wrote back with questions and just enought to give them enough rope to hang themselves.

      Sent the prelim stating why I was mis-sold these insurances, quoting relevant legislation showing them the error of their ways, regarding destroying recorded telephone conversations.

      And yes they saw the error of their ways and as a gesture of goodwill all payments refunded oh and of course 8% interest to boot

      It took me approximately 3months of questioning to get a just result, so it shows to be persistant to turn around their disgusting business tactics

        Could you expand on what they were doing wrong and in what way it was missold for the benefit of anyone else who may have a similar problem

            Hello All,

            Just a update regarding this scenario, The cheque finally came and is now safely in my bank account.

            The moral of this story is about not giving up and chip chip chipping at them.

            This account I had with creation finance had a low credit limit and I used it only occassionally, paid the minimum amount and never looked at the monthly statements, but of course in retrospect know better.

            I do recall a telephone call from creation finance regarding a accident policy and I told them that I was not interested. End of it so I thought.

            A few months later, received another call from creation finance regarding a death plan, discussed it and again I was not interested and told them so. Never thought any more about this either.

            I only realised after I got my SAR and realised that certain amounts had been taken for these two policies for accident/death plan. These amount came to about £20 a month.

            I wrote to cf regarding this and asked for these payment to be returned. They stated that it had nothing to do with them and I had arranged this with a third party. mmmhh

            I contacted the third party and asked very very nicely, if they could provide any information regarding these policies.

            And of course the information started trickling in, slow but sure They blamed cf and cf blamed them. They truely dug a bigger hole in their denials I then sent for a SAR, asking for all info and the recorded telephone calls.

            Oh they only kept them for 3 years and then safely destroyed them. Told them the errors of their ways regarding the dpa and asked for a copy of the certificate of destruction of the recording and they could not comply.

            I then went for the jugular and asked for it back. Asked for all payments returned and 8% stat interest to boot, and was very surprised that they agreed after the first request to pay what I had asked for. Rather suspicious, maybe should have asked for more.

            This I deem to be based on commission based selling Cf received commission for the selling of my information to this company, and this included my account details for them to receive payment, and then cf received commission on the sale of these policies.

            So cf are not quite of the hood with me yet. The other matter I am dealing with at present is the transfer/selling of this account to ge money with no credit agreement. Oh and they cant produce the ca either breach of the cca and breach of the money laundering regulations, very serious issues, but will still have to fight them, they bury their head in the sand, deny and state untruths and hope you will go away.
