I had a loan with Clydesdale Bank and also a cc both around 2001, both paid off through a DMP in 2007 and after a lot of hassle finally got my account numbers from them. In regards to the loan, they had to go to a different dept (local branch had to retrieve info) and I only received a letter saying that yes I did pay PPI and if I wanted to make a complaint, why? I did not get any loan applications just this letter. The cc had to go to a different dept also and I ended up asking for a DSAR for ALL info they held on me. I received this back and all it had was cc statements for 12 months from 2001 to 2002 with no application form. Why was the loan details not in there as well as they specifically stated there was no details for loans and yet approx 2 weeks earlier i received the letter confirming my loan A/C no. I know my cc A/C was taken over by CCCS in 2002 but would they not have my application form as well? I think they may be keeping info from me. Also in my DSAR request i asked for ALL destroyed info to be accounted for and listed and by whom but none of that either. Advice please..:tung:

Hi there
Sometimes the credit card/loan agreements are requested separately to the DSAR request, silly I know because sometimes they are included within the SAR or you request it under another letter by enclosing £1 cheque or postal order, ask that they provide this agreement under the account number of xxxxxxxxx by 14 days.
However, if they're unable to provide you with any details, because for eg: the account was closed longer than 6 years ago they should confirm this to you.
It can vary from one business to another, where some will still hold all info from the 90's and so, even if the account is no longer running.
Another things as well, if they do not comply to your request, you can forward a further letter which is usually called "a letter before further action" and threaten them with the Information Commissioner Office (ICO).
Google them in and more details should come up on what they do.

I specifically asked for ALL info for personal loans AND cc. It states that due to the passage of time since closure (6 yrs in November) they are unable to supply any personal loan documents as paperwork was destroyed in accordance with the fifth data protection principle. They also advise that they can find no trace of mortgage accounts in this name (I never asked them to). How can they tell me then that I did have a personal loan and give the account number in anoter separate letter but not produce any documentation and state that they have destroyed all paperwork?

Hi again, its now been 3 weeks since writing back to Clydesdale asking for ALL info they hold on me (including my bank a/c info this time also and I have yet to hear anything, I gave them 2 weeks to comply and i know the letter was signed for on the 3 sep, I know they have more info on me, this as been going on for 5 months now and I haven't even started the ppi complaint with them yet, do i take this to the next stage or give them another few days?

This all started in me trying to find out IF i ever paid ppi on the loans (they say they can only find one when I know I had 3 in total) as i am sure i did, and the cc. It is less than 6 years since both accs were closed even though CCCS took over ( I have been assured they should still have all details after contacting FOS) and i just want clarification as to what info they have cos if they have the details for the other loans then obviously i will be pursuing those as well.

Suggest that you make Section 77 and Section 78 CCA Requests @ £1.00 each, asking for copies of the original true executed credit agreements for each.
If you took out PPI it should be shown on the agreements!

My accounts have been closed for a number of years, i was under the impression that Clydesdale (or creditors are not obliged to give info on accounts that have no money owing on them) and that is why I sent a SAR.

Finally had a reply from Clydesdale today (16 days late) in regards to follow up letter asking for ALL info for DSAR and have been told that again, due to passage of time since closure, all paperwork has been destroyed as retention period for products have now passed??? My credit card was paid off in Nov 2007 (less than 6 years) through a DMP. Clydesdale state that my credit card agreement was terminated in feb 2002 and that they are unable to evidence how long the a/c was held before arrangement was terminated and cc charged off. My personal loan was passed to collection in sep 2001 and repaid Jan 2008. I thought they have to keep my data for at least 6 years after being paid off (I was told by someone in Clydesdales ppi it's at least 10 years but from my local branch they say its 7 years which I have in writing). Really confused now!!! Can anyone clarify please???

Hello Juju221, that's rubbish from them. I had a Yorkshire Bank loan ( Now Clydesdale ) in 1999, went into default in 2001, repaid through collection company ( Marlon Financial on behalf of Clydesdale Bank ) in 2007. Had PPI on the loan and they upheld my complaint in 2012. All I had was account number which my present bank the Halifax gave me ( as I was paying as an standing order ). I m not sure about Credit Cards but would of thought they kept information on that too for longer than 6 years.
