  • FSCS - Compensation Rejection PPI

    Hi All

    I have just joined the Legal Beagles forum and its good to be on board !!!

    Don't know if anyone can assist with this one - Was pursuing mis-selling of PPI against Halifax. Halifax rejected claim saying that they did not actually sell the policy, but an IFA did, IFA is no longer trading (although no doubt both benefited !!) and need to contact FSCS which I did.

    FSCS contacted me 14 days later in June 13 stating that because the policy began in May 2003 it was before the Jan 2005 regulation date therefore they couldn't help!! Any ideas welcome - is it worth writing to FOS?? It was a 7 year term loan - the premium over the term was over £8000!!

    Any help greatly appreciated..

    Hi and welcome

    Yes you can try another avenue, its an avenue the Financial ombudsman service (FOS) always suggest due to similar reasons as your's.

    Try to find out who the underwriter/insurer were of the policy, if you do not have details of these, then Halifax will provide these details to you on request. Its very likely the underwriter were regulated, where the FOS do tend to take these cases on if they (the underwriter/insurer) also rejects your complaint.
    However, it's about wording it right when you write a letter of complaint to the underwriter, for this complaint to them I would not use a PPI reclaim complaint questionnaire but letter only.

      Dont want to sound nosey but what product (mtg/cc/loan etc) was the ppi sold with? Mt mtg ppi and credit card were both taken out with hbos around about the same time. I havent claimed back ppi on them as they saved my bacon a few years ago, both paid out for 12m when I underwent a brain opI have all the paperwork if you want me to check who the underwriter wasLet me know ...

          Thanks for that - will contact Halifax to find out who the underwriter/insurers where - wouldn't mind seeing a draft of your "underwriter letter" that would be a big help.

          Appreciate your help - will come back once find out who they were..
