  • MBNA rejected my PPI claim

    hi there,

    hope some one can help me with my MBNA claim.

    Although my accounts are settled in 2010, Im sure that i had PPI on both of my Cards (MBNA & Virgin). So, I have applied for PPI claim and SAR on my MBNA account in July 2013. i have received SAR couple of days ago and PPI claim rejection letter today (which i assume is standard templete that is sent by MBNA to most).

    What i can see on my Credit card agreement (which was sent in SAR ) is that there is no tick on '' payment protection cover'' but when i thoroughly went through all the paper work (call notes of MBNA e.t.c) i found a note written as '' PPC SOLD ECG VERB DISC'' & on the additional comments page as '' CRM: PPC STANDARD Solicited''. Doesn't this mean that they sold me PPI during a phone call ? Statement pages of SAR doesnt show any break down of payments made. All it says is ''payment received thank you.......£x''

    Can someone please advice me on this..and how to proceed further....whether to write to MBNA or Pass it to FOS to look into it.

    Hi Blackhorse. It certainly does look as though PPI was sold to you by MBNA during a phone call some time after the account had been opened. You may remember such a phone call, but PPI was often added to credit card accounts without the cardholder's knowledge or consent, and entering a fictitious phone call in your records would not surprise me.

    Your statement copies should show all transactions, and any PPI should be shown as a regular monthly charge. If your transactions are not shown, then you can't see when - or how much - you were charged PPI. I suspect that the lenders are now deliberately sending out non-itemised statement copies with DSAR's in order to make it difficult for prospective claimants. I would write and demand that they send you itemised statement copies. Don't mention the apparent phone convo as yet, though - wait and see how they respond to your PPI claim first.

    I don't suggest you refer the claim to the FOS until you have exhausted every possibility with MBNA, first. The FOS will usually take a very long time to deal with PPI claims - usually many months - often years !!!

      I will definitely write to them for itemised statement copies. Is there any template to do so ??

        I'm afraid we don't have a template for this as yet - it has only become apparent to me recently that this seems to be a new trend. This is a recent example:-

        Data Subject Access Request - Pursuant to the Data Protection Act 1998

        Thank you for attending to my DSAR, and for your letter of XX/XX/XX.

        Thank you for your invitation to contact you if I have any queries relating to the data, and I will take you up on that, if I may. The data supplied does not include copies of itemised statements, yet I would have expected it to be a requirement that you hold this data. There is a summary list showing monthly account balances, but no detail of transactions. Please would you send me copies of itemised statements.

        I thank you in anticipation of a prompt and full response and compliance.
