    No that was it TM! all I got from FOS was that Barclays were making a "goodwill" payment, but no figures when I phoned to ask they said it could take a while but to wait until I got the offer, however it seems Barclays assumed I had accepted this.
    No other records at all, have checked and double checked, let us see what the DSAR reveals!
    My small "success" with Cabot has given me hope!

      I did think that the 2001 related to my going on the payment plan, but again dont think I have any thing in writing for that, it would have been a previous address, moved in 2004.

          Quick question, do I "withhold"payment while I wait for them to respond, or do I continue with the payment plan, paid this months but that was on the statement I got on the 7th, they are not usually that quick adding it on and I would not put it past them saying I had defaulted on the plan

            See what others say, DT, but I agree with you that witholding further payment will probably cause more problems for you than it will for B'card, and achieve very little. Unless/until unenforceability deffo applies in this case, then it is probably best just left as a threat for now.

                I wouldn't use the 'Without Prejudice' header, myself - it can seem like a challenge. Just mention that their conduct thus far may not be looked upon favourably should the matter need to be referred to a higher authority, and that the lawfulness of their entitlement to pursue you further may possibly be questioned.

                      Not done anyway, it was just a question, earlier I was told that I could with hold payment until they complied with a CCA this is a bit different as it is now a SDAR, I asked in the letter that the account be put on hold but as yet not got a reply.

                        SDAR arrived today just pushed through the door via DHL! I thought I would have to sign for something like that?
                        Anyway, not read all of it yet as most of it looks like it was spewed out from a dot matrix printer.
                        They have NOT sent full statements, only going back to April 2004 ( according to them the PPI had been calculated from 2001.)Eventually a very poor copy of the origanal application form, no terms and conditions.I did phone to ask but the person was in an over seas call centre and gave me the number for the PPI call line.
                        Called them again and of they say they are right and said that they only keep records from six years ago, is this correct.
                        Spoke with FOS agsin and they say that they have given them until the 11th of September to respond.:mad2:

                          Am i thick?records only go back 6 years they say? they sent records going back to 2004?2013 minus 2004 equals??????????

                              I did try to tell the person this but they were reading from what appeared to be a script, put me on hold and then came back with the same!

                                Got halfway through the "dot matrix" lot, this is supposed to be "legable format"? Still cannot make sense of it.
                                I am still as much in the dark as to the ppi refund.
                                Should I write again to the data department to "tell" them it is incomplete?
                                I know the FOS said they should respond by the 11th but do they " have" too, it seems they have decided that it ends the matter.:rant:
