    Hi

    I have had a series of consolidated loans with Abbey Nat.

    These were in 1995/6/7.

    I have all my bank statements showing direct debs (no acc number for loan thou with direct debit)

    Complaint knocked back from Santander.

    I wrote to CEO and it was looked into again - declined again

    Sar submitted - they eventually came back to say no details and all data destroyed after 6y. I have written back requesting evidence of destruction.

    Where to go from here?

    These Banks do not destroy all information after 6 years; that's a cop out!
    Remind them of The Money Laundering Regulations and HMRC...

    Banks generally, are most swift to suddenly find account information when that have been issued with a court claim...!

    Maybe, also ask them why monies were being debited?
    What was the money for?
    Where did the money go?

    Santander, clearly do not want to refund PPI monies to many customers who had loans with other financial institutions prior, to them being taken over by Banco Santander!

    If, they still wont budge apply to the underwriter for refunds.

      If the final loan of the consolidation 'string' was still active within the past 6 years, then you would have some evidence of the existence of the loans - but it looks as though this was settled over 6 years ago, as they say they have no data. You MAY get evidence of destruction, but I have usually found this to be difficult, as they often say that providing this info breaches their own security - and thus the DPA !!!

      If your bank statements show clearly enough what these direct debits were, then they may be sufficient evidence to show that the loans existed. However, that would still not prove that you were paying PPI. If your bank was not Santander, then a DSAR to them may provide some more detail - but that's a long shot if the loans were settled over 6 years ago.

      If you can find ANY documentation regarding the existence of these loans, and of PPI on them, then that would help. I fear, though, that in the absence of this evidence, it's a claim which you cannot substantiate and one which Santander are not obliged to acknowledge.

      EDIT: Following the advice by AC above may well get you the evidence you need. AC has been a PPI reclaim campaigner for longer than I have !!!

          Ooh I know Santander too well, and they do tend to fob/reject old accounts.
          Yes Underwriter/insurer time, Santander will have to tell you who they were, so give them a call.

            Thank you all. I know the insurers were legal and general, now aviva

            Santander got ME to ring them to see if they held policy details. Aviva said all loan ppi was dealt with in house and they only dealt with mppi.

            Bit evil of me, but have also sent a SAR to aviva. I tried to claim on policy and it was declined ( was working on temp contract which finished abruptly)so I fail to believe between them no one has any details. On this basis I am adamant there is ppi there.

              Could I please ask for some advice going forward

              Got a reply from aviva sar (underwriters) to say they havenever heard of me

              Perhaps i am being dense

              But if they havent heard of me, how can I persue them as underwriters?

                That is strange

                I would contact the broker and ask if they are sure they given you the correct underwriter details, just in case. x
