    I also really feel for you. I am having exactly the same problem with HFC.

    Despite the loan being active within the last 6 years they claim to have no records. I've sent them all the loan agreement paperwork as evidence (and its a clear case of mis-sell) but I don't have copies of my bank statements as evidence of payments. The loan was for 48 months and the bank want £3 per page for duplicate copies and HFC say they won't re-emberse me if I seek them.

      Have you tried requesting a Subject Access Request (SAR)? with this request the data dept should send you all they hold on the account, it should be a separate dept to the complaints section.

      How far did you get with this complaint? and have they provided you with a final decision?

        Santander are not the easiest, even with mine by providing them quite a bit of evidence they still state they could not take the complaint further because of the age of the account, where they did not hold information (Despite the fact I believe I sent them enough of it)!!

          Dont want to hijack this thread just sharing experience. Waiting for a decision but all the letters so far say they have no records of the loan and no evidence of payment and put the onous back on me to provide. With the six year rule i rekon they should keep records until March 2014 for this loan!

            Hi guys,

            That 'no records after 6 years' is their usual standard response.

            I would be inclined to write back, insisting on seeing a copy of the certificate of destruction/disposal. (With a SAR, they are obliged to either send copies of the data, or give a valid reason why it can't be done; if they're implying that the records have been disposed of, make them prove it!)
            Also, let them know that failure to comply will result in a complaint to the ICO & FOS.

              That's ok!

              Was that the complaints section or the data dept section? They have 2 different depts and many say the same thing. It may be a different matter when you literally send a SAR, as they MUST comply by Data Protection Act (DPA), if they are not able to provide anything, they must by law return your payment with a letter to explain on the reasons.

              Myself and others have been informed the same by complaint sections, then a SAR request have proved them wrong.

                  Quick update

                  I wrote to ceo and complaint was re-investigated. Knocked back again

                  I have written back re sar and said that if they dont hold records , I wd like certificate of destruction

                  Where do I go from here?

                  Surely if I refer to FOS ( i only have bank statements showing direct debits), then surely its going to be a difficult one for FOS to adjudicate on. Am I flogging a dead horse?

                    I'm just about to start my own claim against an old 1999 Alliance and Lester Loan. Does anyone know how much payment evidence they need? I have the original signed CCA for the loan along with sporadic bank statements from around that time.

                    Do they need evidence of just one payment or all of it?

                      Well I am still awaiting a further reply to my SAR, but I did just proceed with the complaint with most of the statements in which I had. I also agreed to accept their offer on the basis that if any other details forthcoming, I will want redress of extra amount.

                      They are very difficult to deal with so don't get your hopes up with them supplying any old A & L statements.

                      So depending on how many you have missing, you could still try sending a SAR first.

                        I can supply them with the original signed CCA and some bank statements from my Current Account at the time showing money going from me to Alliance and Lester, I wonder if they will want to see the full payment history.

                          Then I would try Subject Access Request first and see what they comeback with.
