Hi all, I currently had a ppi recovery request with Santander where in the 1st instance they said that there was no trace of any PPI policy ( ex Alliance and Leicester Personal Loan ) So I sent them the copy of the loan agreement which clearly showed that there was a 3 year policy on the loan from 1998 to 2001.They have agreed that the PPI would have been mis sold on the evidence I have provided ( the agreement ticked all the usual boxes to verify a miss sell ) however they are refusing to make any redress as they have no evidence of payment and have asked me to provide proof of payment. That would be fine however the account the payments came out of is a Santander account held since 1995 and still current BUT they state that they only hold account records for 6 years ( as they advise they are required to do ) and ALL the loan info is from Alliance and Leicester who are now part of Santander and guess what .......yep they don't keep any records over 6 years old - So they ask me to provide proof of payments made knowing quite well that they are the only people I can obtain these from and they state that they don't hold such records - I know that this was a full tern loan and was paid up - Kop out ? Yes you bet your ass it is . Any ideas how I can prove payment or indeed if I am indeed obliged to ? I have thought about Experian report but not sure that they would still hold records. Any advices would be greatly welcomed as I feel that they are using the slightest technicality to avoid their repayment responsibilities.

I finally lost my patience this week and wrote a rather pointed but polite letter
Got a call yest from exec team - things are being looked into

Just re read your post again
My issue is that I can provide them with all the bank statements but not loan agreement. Mine is from similar date
Off all the banks I have dealt with, I really do find them hard work
Would suggest a SAr for your statements, but they havent even responded to my sar, exceeded the 40 days and have cashed my cheque

Many of us who have had older accounts dealt with by Santander have been in the same position, so myself and others have been successful in getting the money back from the actual insurer instead, so hopefully this will be the case for you, if Santander doesnt want to play ball.
So what you need to do is find out who the insurer/underwriter was of this account, by contacting Santander, unless you already know who they are, you then write to them.
You can make the insurer aware that Santander admitted there was a case of ppi mis selling but with the fact the account is old they will not comply to it, so with that you enclose a copy of your letter of complaint to them and wish them to refund you in full of what you paid of the PPI plus interest.
PM me if you want the letter I done as well, you can use to help you, but to add your own little bits of tweak to it.

Was your's also Alliance & Leicester TOB.
I note dpb3770's complaint was originally for A&L, and as you know Santander deal with many complaints via other businesses, mine was GP Cap one bank that Santander dealt with - but my Insurer/underwriter was Genworth Insurers, so depending on who the original broker was really.

They are obliged to send you all data they hold which can identify you, or alternatively give the reasons why they can't.
If they have disposed of/destroyed the data, they should have a record/evidence of the safe disposal of same.
Write back asking them to get their sorry backsides in gear, & inform them that, if you don't hear from them within 7 days (they've already had 40+ days), you will complain to the ICO. (Who can, & do, fine firms up to £500,000)

Thank you to all of your replies. In regards the actual insurer, I will contact Santander ( call costs currently stand at over £15 this month alone !!) and request this info and will come back once I have their replies. Will also ask them their position on destroyed data ( as per Charity NJW ) Thanks again you guys and I will update you on their responses.

Dont have a copy of agreement. Just the details i was given from santander over the phone
Really dont know if its just me but i really do find santander a pain to deal with compared to other lenders
I intend taking action on the SAR this week

Yes you are totally right, they are hard work and do not want to play ball with older/closed accounts.
But dont worry, at least we have other avenues to go from there (insurer) etc, as the FOS would only suggest. (Did you have a copy of my letter by PM) some time ago? I can't remember who I forwarded a copy on to now? lol but if not your welcome to take a look and use it to help your letter to your insurer by tweaking to your requirements. Let me know, cheers.

I have your letter which was great for Santander/Ge capital storecard
This 'battle' is abbey nat loans and they are being equally obstructive
Can i go after the insurer for the loans even though abbey were regulated at time of sale?

If the business are/were regulated, and they reject by a final decision what I suggest (in my opinion) for example, if we have exhausted the complaint with the business where they will no longer look into the complaint (whilst regulated) is write/email the Chief Executive Officer) of the business to ask them to review because you feel the business failed you, and if still no joy by 14 or 21 days (whatever timescale you give them) is then move to the FOS.
Because the FOS are only able to regulate and take on complaints if the business were FSA or GISC regulated if at time of the sale.

What I cant understand in this case and Op case is why they are being so obstructive!
Surely they must realise they are going to get hammered with FOS fee and the cost of the investigation/defence
Perhaps thats just my black and white view of the world
Or again perhaps its just a case of who backs down first with Santander and they hope its the customer
