Hi , my mother and farther had a joint mortgage and unexpectedly my father suddenly passed away ! My mother then paid the mortgage off which was with Halifax but I'm trying to find out on her behalf whether she can claim back any PPI that may be owed to her even though my farther is deceased ? Re: PPI mortgage claim when in joint names & one party is now deceased please help
Thank you to Labman for retrieving this, and I'm sorry it wasn't noticed earlier, Laura. If this was a typical joint mortgage, then I am sure that your Mother has every right to reclaim mis-sold PPI. After all - she was still liable for the repayment of the mortgage in full.
Mortgage PPI can be difficult to 'pin down' though, as it is often set up as a completely separate 'free-standing' insurance policy, and may need to be identified from old bank statements. If your Mother has sufficient records, then this may be possible - but if not - then she should consider sending a Data Subject Access Request to Halifax. This costs £10, but it should provide her with ALL relevant data which Halifax hold in connection with her. If her bank was also Halifax/HBOS, then this should also be covered. For mortgages, this should cover data over the last 12 years, and for other accounts it is 6 years.
As it has been some time since you first posted, then you may not see this reply. If you do - and you would like to continue with this matter - then please do post here ASAP, and we can continue with this.
