Hi, i'm new to this and just wondered whether or not anybody has been in the same situation as me. It all stems from the dreadful Welcome Finance. In May 2000, April 2002, May 2002 and December 2004 i took out four loans. The first loan had PPI on it and Welcome are saying Aviva was the underwriter, Aviva are saying they are not, the 2nd and 3rd loans are been looked at by Aviva and the fourth loan Welcome are saying it had no PPI. Well the question i have is, i had an emergency caesarian section on the 26th Sept 2002 and was injected in my spine and could not work, Welcome were aware of this and forced me to take out a loan in Dec 2004 to help pay for the other loans. They knew i was unable to work and even arrived on my doorstep with the paperwork. Then things got nasty, i could not afford to pay for the loan they forced me in to taking, they threatened to take my home and in the end i ended up selling my home and paying them 28,000 as well as the monthly payments, i incurred late payment charges etc and just wondered where and how do i pursue this and has anyone else been in this situation, thanks.

Have you made section 77 CCA requests? (Requested copies of the credit agreements)
The Irresponsible Lending Regs come to mind...!
Trading Standards should have been advised about these shameful 'BULLIES'.

Oh blimey what you been through is absolutely awful!! Obsurd treatment.
I would make a separate complaint about the Customer Service to the Manager or Chief Executive officer (CEO) about the way you been treated. Separate from the PPI reclaiming.
For a start it's down to them why you ended up in this position and with that the CEO may even take into account of the PPI and consider refunding that as well as the PPI.
Usually you pursue the actual broker who set up the application with PPI. And they usually pass you on to the lender where it is mainly the actual lenders paperwork. Did welcome set up the very first application of the loan, or was you passed on to them after the application was completed?

Hi and thank you all for your advice. Aviva have agreed to pay the PPI on one of my loans, but refused the other on the grounds that it was a HP agreement and that i should have been aware, I replied to Aviva on the advice of the Financial Ombudsman this morning stating that i was forced to take it, i was pressured with phone calls and told that if i did not take it i could not have the loan. The first loan on the 8th May 2000 is still in dispute, Aviva say they were not the underwriter and that Welcome have to give the details; i'm just waiting to hear from them as to exactly who it was. The Financial Ombudsman passed my other complaint to the Customer Contact Division who are looking at my loan for £6927, the loan i was forced to take otherwise they would take my house, which in effect they did in Feb 2006, i had to sell it to pay them back, the Customer Contact Division have said they are writing to Welcome because of the fact i was bullied, i was pregnant again with my daughter who was born two months early and the fact thati was unemployed to to the injection in my spine when my son was born, i will keep you posted on the outcome and thanks again for all your advice

I have recieved a reply from Aviva regarding the rejected loan, ( they say it was different type of loan because it was HP for a car), i wrote:
I have this morning been in touch with the Financial Ombudsman (xxxxxxxxxxxxxxxx) who advised me to write to you regarding the above loan.
I have carefully read through your comments in relation to loan agreement:
xxxxxxx- £xxxx, 2002 with Welcome Finance.
I do not agree with your decision to reject my claim and I have highlighted the reasons below:
- Firstly I was forced to take the loan, they hounded me with phone calls
- I told Welcome Finance that I did not want the PPI
- Welcome Finance told me I could not have the loan without the PPI
- I was pressured ( I was 2 months pregnant at the time)
I truly believe I was misold PPI and would request that you look at my complaint again and refund the premiums paid.

I think that the ombudsman has to have a "final decision" when I took ours to them, last year, they rejected on the grounds it was nothing to do with them, so it went to FOS.
However, out of the blue,last week we did get an offer of redress from Aviva, Welcome " have, in a small number of cases named them on policy's" I bet that we not a "small number" ours were Welcome as well and the other is still in dispute but we are laying a waiting game with that one!

Hi, just to update you all, i've spoken with a very nice lady from the FOS and she has taken on my case and is in the process of contacting Welcome with regards to my first loan where the Underwriter (according to Welcome was Aviva). She is also contacting Aviva as to why my other claim was rejected. I'm still waiting to hear from the Customer Contact Division who are pursuing the irresponsible lending code in accordance to my forth loan in Dec 2004. Will keep you all posted.

Hi all, recieved a letter from the Ombudsman this morning, he has written to UnWelcome Finance with details of my complaint and given them 8 weeks to respond, the letter was addressed to Ms Ann Clough at Unwelcomes head office, she must deal with the irresponsible lending claims, will keep u posted of their reply.

Hi, just another update! Recieved a letter from Welcome Finance and they say they have no record of who i am! Very hard to believe when ive been communicating with them for the past few years and the fact that the Ombudsman has written to them on my behalf. They asked me to send in proof - birth certificate (which they already have). I rang them and the lady asked me a few security questions, which i answered correctly, so if they say they dont know me, how did they have the details? She went on to add that id passed security and would deal with my case, i did inform her that i would be contacting the Ombudsman with regards to the letter, she did not seem happy. Will keep u all posted when i hear from them.
