provident personal credit

  • provident personal credit

    Hi

    I took out many moons ago a provident loan which was paid up in full. Im pritty sure it had ppi attached to it but not 100% certain. I no longer have any account numbers or paperwork on any of it,
    Is it possible to sar them without a customer number? If it is possible what information do i need to provide and what would be the best address to send it too?

    Yes, it is, because a Subject Access Request is a request for all data held about YOU, it's person-based, not account based.

    This is the letter you should send them, with a cheque or PO for £10 which is the statutory maximum fee. Send it recorded delivery so you can track it, they have 40 days to respond:

    Dear Sirs

    Subject Access Request - S.7 Data Protection Act 1998

    Please supply me with a copy of all information your company hold on me including a list of accounts and details of payments along with copies of statements.

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memos, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on all types of media in any relevant filing system (microfiche included). If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge. I also require that you forward a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by you about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request and note that this request has been sent Recorded Delivery so I can ensure compliance on these issues comply within the legislative time frames.

          I had provident some years ago, cannot recall about PPI though, maybe worth checking but don't think there was with me anyway, however their interest rates were very very extortionate x

            Thanks again FP will give it a go.
            Di, I actually had a loan for a car think the garage i got it from used provident for finance, I do recall high interest but like Ive stated not 100% about ppi, all very vague i my memory now so maybe getting crossed wires. Think it maybe worth the £10sar fee, never know it may bring something to the table for me to work on

                  New to the forum but w/ a similar situation. Can you tell me what the verdict was on this one? I've considered auto loans with bad credit and was considering a similar course of action.

                      I don't think Prov do ppi on their loans do they? It would be worth digging out your agreement, or a simple phone call may resolve the issue.

                        From what i can recall I don't think PPI was ever included, not came across any old agreements yet, but I do know their charges were very excessive, but its one of those companies that offers easy money quickly, one though I would never with again too.

                          With provi doorstep loans you WERE told all the charges and as is said they were easy to get served a purpose for some

                            I do not know if this helps but I used to work for a small claims mgt company. We did do an exercise into Provident personal loans. From memory they did not come with PPI as such but came with a package which covered a certain number of payments to be missed for various reasons. The next step appeared to be trying a claim to test the water and possibly a court claim if a willing volunteer could be found but I do not think it got to either of these stages before I left. Basically the thought was that there was a form of protection/"benefit" built into the product and therefore the interest rate and thus there was a cost to the borrower?

                              Round here, they're happy to accept a £1 payment indefinitely. If you miss 10 weeks without paying anything, then it is passed to 'the office.' Our next door neighbour collects for them!:beagle:
