  • Newbie Halifax PPI Claim Refusal

    Hi there,

I have been scanning the internet for information about PPI claims being rejected from the Halifax and came across this site, which is very informative.

I had a credit card taken out in 2002 when I was 18, at the time PPI wasn't mentioned to me and was given no information about it, I was just asked to sign the credit agreement.

Halifax have since written to me to say they believe the advisor acted within reason and cannot see how PPI could of been mis-sold to me and will not UPHOLD my complaint.

Just wondering where I can go from here should I write back to them or go straight to FOS?

    Thanks
    Lee

    Hi Lee

    And welcome.

There appears to be lots in the same position in regards of Halifax, as you all seem to be receiving the same generated decision letters, as if they not even bothered to look into it.

Write back, even if you received the final decision, tell them you disagree with the decision they made, as you only made a complaint as you now realise you have a case to do so.

If you have received the final decision, then forward the letter to the Chief executive Officer (CEO) of the dept, tell them you are not happy with the decision you received from the complaints team and you believe you received a standard generic letter of rejection, because it does not appear your complaint have been at all investigated or they have overlooked it.

I would also forward any further information, for example, when you were 18 and sold the card, were you in full or part time employment?
If part time less than 16 or 18 hours then the policy would not have been beneficial for you, as you would not have been eligible to make a claim for eg, sickness/unemployment.
Or if you were unemployed or a full time student it would have been worthless to you.

If you had a pre-med condition at the time it was sold to you, then let them know, as your not able to make a successful claim for that particular medical condition etc.....

If it was sold in branch, make it clear to them about this as well, just say you can clearly remember being sold the credit card, and just shown where to sign without any discussion of the PPI, and because of that you assumed PPI was all part of the account package.

Give them 14 or 21 days to write back to you, ask them to review, then if you hear nothing or if they do not overturn their decision, then complain to the FOS.

    Good luck.
