  • PPI-Claim. MBNA No response to SAR

    Hi there, need help..

I have 2 credit cards, MBNA and Virgin (which i belive a part of MBNA) that i took out in 2005 and I am in a process of applying for PPI. i am sure i had PPI on both them. Just to make sure before i go ahead with PPI, i have requested for SAR on 11/01/2013 enclosing £10 cheque respectively. MBNA have encashed the cheque's on 23 jan but did not respond to me until now. I have sent another letter on 15/03/2013 informing them if they fail to comply with my Data Protection Act Subject Access Request then I intend to make an official complaint with the Information Commissioners Office and have give them 14 days to respond. No response until now...
Can some one please suggest me what to do next...Complaint ICO or call MBNA to find out what happing with my case ?
If it is better to call MBNA then can someone give me a contact number please..

    Thanks..

Re: PPI-Claim. MBNA No response to SAR

Your next step would be to complain to the ICO, you can do so by email if you can supply all the documents electronically: http://ico.org.uk/complaints/getting/complain

It can take time to get anywhere with the ICO, but I doubt you'll have much more joy speaking to them over the phone. Surprisingly, MBNA complied with my SAR within the 40 day timescale and supplied me with all data from 2004 (I SARd them in 2010). Shame they couldn't find a copy of my credit agreement...

You should have sent MBNA a reminder after the 40 days had expired!
They are generally late in sending out SAR's.

Your can of course complain to the ICO
