  • Trying to unravel a PPI claim

    Hi there,
    we have recently been told by our new financial adviser that we have been mis-sold a PPI which we have been paying into since 1996 but we can't work out who to chase.

    It was sold to us along with a Halifax mortgage which we no longer have. The company we currently pay in to is the Wessex Group who are part of Aviva but the policy number has changed along the way, possibly as one company merged with or sold to another. We have a letter dated 2001 from Norwich Union (now Aviva) "confirming your acceptance under the Payment Protection Policy offered through Royal and Sun Alliance". They have attached a copy of our Schedule of Insurance with our original policy number.

    We have contacted both the Halifax and Aviva and they both say they haven't sold us the PPI and to contact the Independent Financial Adviser who sold it to us. 1996 is a long time ago and we don't remember who sold it to us and the paperwork is lacking.

    Should I now contact Royal and Sun Alliance (Phoenix?) or are Halifax or Aviva just trying to fob us off? It's very confusing.

    Hi and welcome

    Usually whoever set up the account from the start are the ones responsible.

    If the insurance was coming out the same time as the mortgage the account number will cover both for the mortgage and PPI (I think)!

    I would send a letter to all of them, see what they come back with.

    Do you have any paperwork at all, application and/or agreement?

      I have the original schedule of insurance but the policy number changed somewhere along the line. I've already written to both Halifax and Aviva and they say the policy was sold to us by an Independent financial advisor. The wording from an Aviva letter in 2001 says the policy was originally offered to us through Royal and Sun Alliance. Should we target them then? Or go back to the Halifax?

        Can you remember who set up the mortgage? if it was done in the bank, then yes it would be down to Halifax, so a bank adviser must have set up the mortgage through them with the insurance, and the insurance they chosen for you was then possibly Royal & Sun Alliance.

        Is the mortgage still active, if you don't mind me asking? cheers x

            "In my opinion" it would be Halifax (if they set up the mortgage) they probably sought the insurance as well.
            Do/did you pay for the insurance within or separately to the mortgage monthly payment?

              Separately. We no longer have that mortgage but still pay the PPI.

                In my opinion then, when your mortgage was set up, it's possible it was set up by an adviser in the bank with the PPI, they probably had a list of their own insurance brokers. So it's up to you if you want to chance it with Halifax again.

                We usually only go the insurer if there is a claim to be made, for example, sickness/unemployment, unless the business who sold you the policy are no longer active, then the FOS would usually suggest going the underwriter/insurer avenue.

                The insurer of the PPI should still hold details of the business/bank who set up your policy.

                Have you tried requesting for the paperwork from the insurer by sending a Subject Access Request (SAR)? x Information they may send back may possibly give details of the business who arranged it direct with the insurer.
