  • Barclaycard PPI Claim refusal - applied for Credit Card Online - URGENT HELP Please

    Hello,

I wonder if someone could help me with my question.
In January I made a PPI claim with Barclaycard. After 4 weeks they responded advising me on the following:

"We have identified that your application for PPI was submitted online. At the point of applying for PPI, as no advice was given the process required you to select type of cover you required.

In addition, we have conducted a review of the documentation you viewed during the sale (I wonder how ???) . We are satisfied that the documentation presented accurately described the scope of the policy, and was sufficient to provide you with all of the information necessary to inform you of the terms and conditions of the policy. (I wonder how they came to this conclusion, as they did not support my application with T&C's advising me that I had rights to cancel the insurance).
As a result we are not able to uphold of the policy.
They also stated that I can complain to FOS and that their decision is final..."

    My question is:

Am I still eligible to respond to them asking to provide me with the evidence in concrete on how they believe it was sold in a correct manner to me, where did they find the information that they were confident it was fully explained to me?

I applied for Credit Card over in Dec 2006 and really don’t remember if this was done online, for sure I was not looking for PPI insurance. Instead I opted in for Barclaycard Card insurance (cover for CC & Identity document loss or theft).

It is really difficult to prove that I did not ask for the PPI, as application was made online. I did not receive the insurance certificate, T&C's, etc - and despite asking them to supply me with the copies of the form, T&Cs they are ignoring me requests. They have also not supported the refusal with any data transfer copy, forms etc.

Do you think that I still have the rights to request for a reclaim ? What are the chances that they would reconsider my reclaim?
Please also note that even though I stated in my questionnaire that I dont want to continue with the PPI, they advised that they will only cancel the PPI if the claim was successful. Which means that I am still being charged for PPI (this is active account) - is this correct please??

I would be grateful for an urgent advice as I received a response 3 weeks ago, but was unable to respond back as I was travelling.
I have read that I could request for SAR and make a reference to FAR, but I am not sure how to handle my case - when application was made online.
Any verbiage for letters would be really appreciated

Please help! I am estimating that they owe me around approx. 2000-3000 GBP

Re: Barclaycard PPI Claim refusal - applied for Credit Card Online - URGENT HELP Plea

I have a similar issue, although mine is more convoluted. Originally we were using Lifestyle Claims who were sent a letter last August 2012 refuting the claim, we had engaged them late 2010 and as we couldn't get hold of them on the phone ever we had given up on them and were thinking of going it alone when we found out they'd gone bump.

Originally the card was a goldfish which I applied for online, I believe the PPI box was auto checked and being younger, less financially secure and more stupid believed the application would be rejected if I did not accept PPI. I had a loan around the same time on which I had PPI for that very reason, that's what I was told. Is there any legal standing to challenge a rejection based on an auto checked box. Lifestyle Claims advised us not to pay off the card just to pay the minimum each month. So we have for two years. So at 270 per month you can imagine I'm not very happy about this (mainly at myself fo being too lazy to sort it out sooner). I do understand the legal conditions of offer and acceptance have been met.

I contacted the ombudsman as Barclaycard told me it had been referred over 12 months ago (jan-12) when I contacted them, so I'm a bit confused about the dates too. The ombudsman said they were clearing backlog, admitting they'd sat on it for 12 months, and would do an initial assessment but I haven't received anything from them.

Is it worth pursuing the PPI claim or should I just beg Barclaycard to move it to Zero interest and pay it off?

SOMETIMES they used to have an automatic tick on PPI which would mean they are liable to pay it back, and sometimes they used words like
WE STRONGLY RECOMMEND YOU CLICK which would make the sales advised even though they were online
The above is pretty much good advice apart from when Marcus gave you out a telephone number which will be removed shortly which is for the bigger scam which is someone else charging you to reclaim your money when you can do it yourself.

Thanks for the responses so far, I've been burned by Lifestyle claims and will be dealing with this myself now so no risk there. The ombudsman initial assesment letter recommends they should settle my claim, but based on Barclaycard practices and a postal application. However, the justification of it was that I had been properly advised that PPI was NOT a requirement for a successful application, which I'm pretty sure I wasn't. Can I argue that this premise stands even though it was an online application?
