Halifax -v-Inca...........guess who won ?? :)

  • Halifax -v-Inca...........guess who won ?? :)

    When I first met Mr Inca,,,many moons and grey hairs ago........Mr Inca had something Inca would not look at,touch,,or use.......infact Inca was scared of it....... So Mr Inca stopped abusing it and tidied it up and put away in a safe place and promised NEVER to touch it again.And there it remains,unblemished,and untouched by human hands. End of story? Not quite......................................

    Inca finds a site called LegalBeagles..and 3 magic letters PPI.....so Inca looks at the PPI threads,,rummages through Turbomans,BillK and DizzyDi's threads and has a 'Eureka' moment (no not the key to Bills whiskey cabinet).

    Inca then contacts Halifax,and puts in a claim for PPI........and gets rejected
    Inca then reads more.......and sends claim and refusal to F.O.S
    Today,,Mr Inca gets a letter saying he overturns Halifax's refusal and has upheld complaint!!!!!!!!

    Yay!!!!!!!!!! So Thankyou ,my darlings,,,,,,,even though you didn't have a scooby I was ferreting around in yer nether regions,,,,you have made me a very happy Inca

      I'm just chuffed it got overturned leclerc,,it won't be life changing money but it's the principle,,I'd rather burn it than let Halifax get away with it

        It depends Inca, I had a similar letter form the FSA back in July regarding an MBNA (Virgin) claim. Turns out it was just an "initial assessment", they have since ignored no less than 6 deadlines.

        My last conversation with the FOS yesterday went along the lines that they were still contesting and required additional proof. This is after they has told me that MBNA had lost their right to appeal due to none compliance.

          If I'm not mistaken Halifax/Bank of Scotland are one and the same? If that is the case then they are also part of Lloyds TSB Group who were fined millions this week for delaying PPI payments!

            Sent to Bank of Scotland Plc,Lloyds banking Group,Central Admin Team,Pobox671,Leeds LS1 9SF (from FOS)..it basically says the PPI was NOT sold as a seperate agreement,,and as Mr Inca was on a 0 hour contract with no sick pay entitlement he had no other means to make the payments...HBOS have till 11th March to either make an offer or agree with the FOS assessment of monies due to make Mr Inca whole again as he would have been before the PPI was sold to him.
            Like I said,,it's not about the money,,it's the principle (although money is always welcome )

              I really hope it works out for you Inca. Every time I hear about the FOS I come out in a rash. Success stories (where they don't side with the company)seem to be as rare as hens teeth.

                Even to my untrained eye the letter from FOS to the bank was quite 'snotty'..and has given them 17 days to respond,,shall wait and see,and of course report on here
