  • Barclaycard Refuse My Claim For PPI

    Hello and Happy New Year to all at LB.

    I had put in a complaint for mis-sold ppi with Barclaycard as I did not know I had the policy but they have rejected my claim.

    The reason as the letter reads:-

    "We have identified that your application for PPI was submitted by post. At the point of applying for PPI, as no advice was given the process required you to select the specific type of cover you required.
    In addition, we have conducted a review of the documentation you viewed during the sale. We are satisfied that the documentation presented accurately described the scope of the policy, and was sufficient to provide you with all of the information necessary to inform you of the terms and condition of the policy"

    To be perfectly honest I do not think it was a posted application, I am sure the credit card was offered to me when I applied for a loan because it was back in 2004 I can not say for sure as I do not have any of the paperwork.

    Please can anyone advise what should be the next step, Do I need to apply for a SAR or do you think I should write to them first asking to reconsider if so any help with what to write would be most appreciated. (I am not good with letters )

    Also any advice would also be appreciated on the fact I am over the credit limit and only reached to get myself in that position with charges.

    I apologise for my delay in responding.

    If you've no paperwork, then it maybe a good idea to request for a SAR, hopefully the relevant information will be enclosed to help your case.
    Did the bank also confirm if the decision is final?
    If so they should enclose details of the Financial ombudsman service (FOS) enclosed with a leaflet on how to make your complaint to them.

    Even if you did receive a final decision, sometimes they will reconsider and review depending on what further info you can provide to them.

    If you are now certain the application was not made by post, then write back and make them aware of this, but otherwise you can request for a SAR, which will hopefully help.

      .........also to add, that we can help you with the wording of the letter if you wish.
      Maybe if you can try at first finding out how you applied that would help, but wondering at the same time if you any other reasons that may also be of some help for your reclaiming, such as: did you have a pre-med condition at the time you taken out the policy? was you unemployed, or if you were employed - at what hours?
      If employed, did you already have cover in place by your employer? for eg, sickness?

      We can then apply these other reasons. ;-)

        Thank you for your reply Di,

        The bank has not confirmed that this is their final response, I will send off for the SAR as I am sure that I might have not even signed the credit card,

        but after three kids my memory is not sharp as it used to be....(at least that's my excuse now!!!! lol)

        I am still considering writing to them while I wait for the SAR ......do you think that is a good idea or shall I wait for the SAR??? (I value your opinion as I have been following ur threads since July and you are the best for advice on PPI.)

        Also while I have your attention I put in a complaint for my dad on his halifax credit card which they have refused also ... the letter is a bit lengthy so once I get my head around it I will b requiring more advice on further steps to take . Would I need to start a separate thread????

          ......sorry with regards to your question about employment ....I was employed at the time and was covered full pay for 6 months sickness.
