    I can understand anyone's frustration with the FOS, especially when you know your in the right, as I have been reading more of it lately, not just because I had issues with them but do recognise it on how they seem to be working, thats quite a few this week now, and reading on the FOS site of ombudsman decisions is very interesting too, maybe worth anyone taking a look x

    Great info/advice by you both lovely, there is nothing more i can actually say at this point lol :-) but for Kelly to continue and dont back down xx

      Thank you very much, I'll have a look at their site, my darling.
      It looks like it is becoming a very worrying issue.
      May be we should start a special thread about it.
      Seems like a pattern, which implies something is not right.
      Looking at the comments from their adjudicator, Kelly quoted, I do not see how the FCA guidelines were applied, in what way. Also, as L'pool said, if something is wrong, does the lack of alternative makes it right?

        That does actually sound quite interesting and a great idea.

        What was said as well in regards of the FCA guidelines etc, something isnt right about this where they are not using the rules and seems like they gone against them, I dont think it makes it right! One sided in my opinion and another thing as well that has come back to mind and i did mention this some time ago, the FOS suggest the underwriter avenues if nowhere else to go with the case, for eg, the broker not regulated and so on, but it seems that 99% of the time, even though its in front of them, they still say they cannot establish a relationship, there must be somebody! And if this is the case why are they not always enclosing the companies of underwriters to the FOS!!

        That is another reason in regards of one of our cases I went direct to the underwriter myself and yes did succeed too, because i know the fos would have told me they could not establish one.

        I had another case with the fos some time ago in regards of a business not regulated, then they write back to say, we have found details of the underwriter who we now pursue, then 2 years later to be told they could not establish the relationship!! Doesnt make any sense unless i'm missing something,.
        In my case when that did happen I was so lucky to later have found more info, where it was realised the it was the lender that applied the ppi and not the broker, as i had found both applications.

            Just recently started investigating my own ppi history. As suspected having problems with M&S Money. Filled in questionnaire and gave reasons for why I believed to have been mis-sold, waited the 8 weeks to be greeted by a rejection letter this week from them not up-holding my complaint. I'm the same as most people where I believe writing in bold lettering "we strongly recommend you take cover" is indeed advise on a "non-advised" agreement. Just wondered if [MENTION=14293]stevesouth33[/MENTION] had got anywhere with the FOS yet with his similar complaint, or if such a complaint is likely to be upheld by the FOS?

              It is unlikely. The ombudsman publish all their decisions now and many M&S cases are turned down by them.

              Why? Well the policies were fairly good. Remember, PPI isn't something that is just claimed back - there has to be a fault in the sale.

              As for the recommended/not recommended thing. It is a poor choice of wording I think. What they are looking for is whether this was an advised sale or not. That means did the firm get you to give details about your circumstances and then make a personal tailoured recommendation.

              In many instances, whether or not the firm is said to have given 'advice' makes little difference to the outcome.
