these claims going in for PPI can only go back to 2002? sorry if I have missed this earlier. I wasn't going to bother with PPI claims but since everyone wants to shaft me I think I am now going to do it.

I took a 5 year business loan out in 2000 with HSBC for £10'000, to cut a long story short they forced me to pay it all off two years later because I was moving house and I had to pay back £11'000 in cash.
I don't have any paperwork nor am I in that bank anymore (closed my accounts down the same day they made me pay of the loan)
1. Will I be able to make a claim
2. how do I go about getting HSBC to send me all the paperwork including payments made
3. they must owe me something as I must have paid around £17'000 over the two years

that's very interesting Di, is there a thread on here that walks you through the process? I'm afraid I have no paperwork from the companies involved, and I cannot remember any account numbers but I believe there are ways around this.

Yes there are ways around this.
If the loan was taken out eith the bank, sometimes the direct local bank will still hold details of the loan.
You can also try checking any old bank statements, the loan account number should be enclosed next to the loan monthly repayment. No matter who you taken out the loan with, as I assume you paid by direct debit every month through your bank.
And often, even with Subect access Request (SAR) to request for all the data on the account they may still hold, if they do not then they must return the fee you pay for the request £10 cheque or postal order, with a full explanation).
If you do want to request a SAR and have not done so yet, I shall post up the template letter you can use, and tweak if you want to to your requirement.
Again, if the loan was taken out with the bank, and you send a SAR letter, they should provide you all data in relation of all finance accounts you taken out with them, so if you had so many loans, credit cards etc, by applying your bank account number, then one SAR letter is all you require, with the one off payment of £10 cheque or postal order.
They have up to 40 calendar days to comply.
And you can fire away on the reclaiming. x

I'm sure you could have taken the loan with you, I know I did when I moved, unless it differs with each bank, but I've not heard of that before to be honest.
Yes you can still make a reclaim.
How long ago was the HSBC account opened or closed? (you could try calling directly in the bank, with your name/address DOB details may help in order for them to track down details).
And yes, if mis sold PPI, they will owe you all you've paid of the PPI, in your case, as you settled your loan, they would have also included the ppi within the loan balance settlement, so you get all the ppi back, plus all the relevant interest.

that's great Di, I just had one loan and my mortgage through TSB which then became Lloyds/TSB. Like I said I have no paperwork or remember account numbers as it is at least 9 years since i had any dealings with them, but there must be some records held by them. Any guidance/help is much appreciated, I am definitely doing it as I have just ordered a new printer for next week especially for the job.

A few of my loan ppi's were as from mid 90's with lloyds and were successful with them, I was surprised when my SAR turned up with data even from then.
You can try by either calling directly into the branch, if that fails, you can optionally try for the SAR, letter template below if you want to do this, although by calling into the branch will save you a tenner on the SAR.
By giving lloyds as many details as possible, full name, addresses you lived in at the time and others, date of birth can help.

Please send me all data that your company holds relating to my entire account history. Please include details of all transactions, and a copy of the original contract by which this account is/was governed at the time it was opened including all amendments made to the contract terms since opening the account.
I would also like a schedule of all charges & interest applied to my account(s) including details of any instances that required manual intervention. If you are unable to provide this specific information, copy statements will suffice.
All data, including data held on a microfiche must be provided within a reasonable timescale, a maximum of 40 days.
In light of all the recent publicity regards the reclaiming of bank charges, some Banks appear to now only be providing a breakdown of charges in response to all and any Data requests. For the avoidance of doubt I do actually require all information held by yourselves.
It seems a lot of banks are also wrongly interpreting the Data Protection Act (DPA) 1998 as a requirement to only disclose six years worth of personal data, and this is also wholly wrong. The DPA clearly states that all information held must be disclosed and it has no correlation to the Limitation act 1980 at all. If you no longer hold data beyond 6 years however, I would like a signed declaration from your data controller and a copy of all documents pertaining to its proper disposal.
Whilst not exhaustive and for the avoidance of doubt I shall list what I require:
* Full copies of all contracts that exist between myself and your organisation; including copies of any documents you hold in support of same.
* Copies of all statements relating to the above accounts.
* Copies of all correspondence, including all letters, faxes, emails and memos sent and received between ourselves, and any other third party in relation to any of the above accounts.
* Copies of any telephone recordings and/or transcripts of these recordings as well as any logs or journals that relate to them.
* Copies of all documents which include any of my personal information including copies of any contracts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.
* Full details and copies of any documents upon which you relied when you have provided my personal or financial information to any individual, organisation or third party.
* Full copies or transcripts of any computer logs or database records kept in relation to myself or in relation to my financial or personal information.
*Details of all systems you currently have in place to ensure my personal or financial information is kept securely, including details of those officers who currently have control of same, and at the time it was held or provided to a third party.
* Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, reason for deletion, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.
I enclose the maximum statutory fee of £10.
You have 40 days to comply with this request.
If you fail to comply fully I shall enter a formal complaint with the Information Commissioners Office which could result in a fine and prosecution.

...........Another suggestion is, to write to Lloyds anyway, tell them you are aware of a loan taken out in so and so date, and you can recall being sold PPI, and believe you have reasons to make a reclaim, give your reasons, also the name of the bank that sold you the loan.
My brother in law been recently successful in making a ppi reclaim from lloyds and the account was taken out late 90's he could not remember the account number, but given details of the bank that sold the account.
So if he can do this, then so can you.

I was furious with the way they blackmailed me but at the time I couldn't see any other way out apart from complying with their demands

And if you do have a case of being mis sold ppi as well, it could be treated as separate complaint perhaps.
Maybe over the weekend one of our guys will clarify on this, and we can take it from there if you want to.

If you cannot find the account number, or if the bank does not disclose this to you, just leave blank the sort code and account number, and give details of your personal details on the actual letter, in order for them to try tracking it down, any problems, let us know.
