  • PPI Reclaim Issue with MBNA EBL

    Hi,

    I have an agreement plan (interest frozen) arranged with MBNA due to my account falling into arrears some years ago in which I have abided by without missing any payments that are due.

    On reviewing previous statements prior to my arrangement I noticed that there was PPI applied to my account in which I did not agree to, so therefore I sent a formal letter requesting my T & C, PPI agreement details with payment of £1.

    I have now received a letter from MBNA refusing my request for details and that I must continue with arranged payment plan ? I was only intending to off-set any funds due against my original debt in order to reduce the balance.

    Should I now just accept it or can I possibly take the matter further ?

    The two things are entirely seperate. If you think you have been missold PPI then you are probably best filling out the consumer questionaire on the financial ombudsmans website and then sending it to MBNA. If your claim is succesful they may then choose to offset the amount of redress against the balance on your finance but that then fulfills your requirement.

      Thanks Steve,

      But I know that I did not choose protection but I am unable to locate original paperwork hence my original request to MBNA with payment for details, in order to provide as much information going forward.

      Should I now just fill in the questionnaire as you mentioned with what details I have and return to MBNA or should I pursue with obtaining PPI documentation again ?

        My suggestion woudl be to go ahead and complete the consumer questionaire, you need to give as much detail as you can including where the sale took place and what if anything you were told about the PPI. If your stance is that you did not ask for it or were told you were getting it then make that clear also. The process for requesting documentation is a SAR (subject access request) which you will be able to find a standard letter on this site and you need to send them ten pounds requesting the provide all available data regarding any dealings you have had with them including telephone conversations. You also need to write to their main adress rather than any other address you may have been communicating via more recently regarding your account.
