Hi Daisy,

Just a quick suggestion, if it's not too late. You are over the first hurdle, which is getting an admission that the PPI was mis-sold. All that remains to be done is to get them to comply with the FSA guidelines - that is ALL the FOS needs to adjudicate on, and is AFAIC a very straightforward job. The FOS can take months and months to deal with claims, but if you point out to them that it is a simple matter of enforcing the FSA rules, then they might possibly 'fast-track' it to get the complaint resolution target figures up.

Meanwhile, have you got a spreadsheet for calculating what you expect ?

This was their original and also last offer

In order to put you in the position you would be in if you had not continued with your Credit Card Payment Protection Insurance from April 2004, we would liek to offer you a refund of PPI premiums applied to your account amounting to £796 (not much!). In addition, where applicable, interest will be calculated on each of these PPI premiums based on the monthly interest rate applied to your Credit Card over the period. The interest figure will be calculated upon receipt of your signed Acceptance, and paid for a maximum of 28 days from the date of this letter, and is in addition to the refund of the PPI premiums. The total refund will be credited direct to your credit card account"

I declined this offer and send about 12 statements to them. However, they only date from 1998 to 2004, I cannot find any later ones unfortunately. The last letter I wrote was addressed to the CEO but was answered by an Executive Assistant! Basically it said the same i.e., that is all they are prepared to offer me and if I wish to accept to sign and date the letter etc., which I have not done. I feel I am entitled to more (not sure how much but my balance 2004 was around £5,000/£6,000 ish and ppi payments were definiately made up to that time which they no doubt know.

The stuff has gone off to the FOB and I have written and informed them that I am now taking further action (didn't say exactly what!).

Also re: Lloyds (other half's claim) again they are refusing to acknowledge they owe him PPI (see other thread).

So now I'm not sure what else I can do in either case but to go to the FOB which I was trying to avoid as I realise this can take months and months but perhaps this is what these banks are hoping people do - just delaying tactics?

The banks seem to be using this 'stonewall' tactic more and more, Daisy, and I guess (as you do) that they are just delaying the inevitable. I think they are running out of allocated funds for PPI claims, and instead of allocating more, they are making claimants wait for their money. This means that the banks profits aren't immediately eaten into by further PPI allocation, and they get to keep their bonuses. Maybe between now and next year they can think up a few new scams to boost their profits. Another thing that concerns me is that the FSA will be split into two bodies in April 2013, and perhaps the banks know something about that which might be to their advantage.

As I think you know, I've only recently adopted the strategy of writing to CEO's, but I think we'd be very lucky to get a reply from the CEO personally. The letters just go to the CEO's office, and a bunch of 'Executive Assistants' sort out the wheat from the chaff. I guess PPI complaints are classed as chaff.

Yes I think you are correct Bill, we are classed a peasants/chaff - not good is it! Definiately a different story when they are taking our money! We are after all, only rightfully trying to claim back what was ours in the first place! It also amounts to fraud for which people have been imprisoned!

Update on this…… I eventually sent the whole file to the Ombudsman. This was well over a year ago. It has really dragged on but now is with the Adjudicator who I sincerely hope will adjudicate in my favour. As you know they had offered me £796 from 2004 although my card commenced in 1998. I received a letter from the Adjudicator the other week asking me to clarify savings which I said my family had and also what sick pay and for how long I would have received this from my employer. I answered quite honestly so will now wait and see what happens. I cannot prove family savings but I feel they likewise cannot prove otherwise, it will be interesting to see what the outcome is!

Thanks for the update, Daisy. It looks like your reason for claiming mis-selling is that you were sold a product that you didn't actually need - but that NBS told you that you did. They have admitted that subsequent changes to the T&C's meant that you were later being mis-sold the PPI, but they seem to be saying that your circumstances at the time of the original sale were such that PPI would have been a benefit to you. If your 'alternative means of support' were family help and employers sick pay - and these can be shown to have been adequate - then there seems to be a good chance of getting the claim backdated to the inception date, as opposed to the date when the T&C's were changed. Here's hoping.

Hi Bill - yes my thoughts exactly. As you say "here's hoping". I think it won't be too long now before I know the outcome. Also I think it has taken this long as they had made me an offer so after the first department at the Ombudsman looked into it, it then got passed to the Adjudicator - let's hope that the wait is worth it.

Hi folks, well, it's been a very long time this has been going on and I had hoped to get back to you with some good news.

However, unfortunately this is not the case. As you know Nationwide initially offered me £796 by way of PPI refunds from 2004-2006 as this is when they changed their terms and conditions, even though I took my policy out in 1998.

I have waited almost 2 years for the Ombudsman to deal with this case and letters and phone calls.

I have just had a phone call from the Ombudsman today saying they are NOT upholding my complaint. I am not a happy bunny as you can well imagine! Their reasons are that at the time I took out the policy it was a postal application and I ticked the box, even though I said I had telephone conversations when applying. They also said that as I was employed and had savings/family savings/partner etc., that the still considered the policy was relevant to my circumstances at the time. I said the usual that I was pressured into it saying I was led to believe on the telephone if I didn't tick the box I wouldn't be granted the card.

I am really spitting feathers over this to say the least. I feel that the Nationwide are getting away with it lightly. I just can't believe it. All my other PPI claims have paid out.

Any ideas/thoughts appreciated.
