I was successful by doing this myself.

If you do not get anywhere, and know who the insurer was for definate, pm me for a copy of my letter if you wish to x

However, there was one a few years ago i did take to the FOS in regards of the underwriter/insurer and was being told on each update the same as what you've been told.
    Hi Di

Regarding your comments hope you don't mind but sent you a PM

    Thanks

              Re: PPI claim against Underwriter

""a link can not be established between aviva and the actual sale.......""

How can there be no link? There must have been some kind of communication between the lender and Aviva prior to the sale completing or how else would they know how much to charge the customer for PPI on the loan agreement?

There must have been an official enquiry to Aviva as to how much to charge someone based on their income etc. before the loan was issued with PPI, unless they have an on-going relationship and charge in accordance with a checklist and the payments to Aviva were automatic, otherwise how would the lender know how much to pay Aviva for that particular policy?

The link would have been completed when Aviva received the first payment due under the terms of the PPI policy I would have thought but I'm not 100% up to speed on PPI yet, but getting there, so have another look at the policy and any other paperwork you may have.

Make sure the information they send you in response to a SAR contains everything they have from when you first applied for the mortgage not just from when you completed the mortgage.

                Re: PPI claim against Underwriter

The FOS 9 times out of 10 come back to say the same thing "they're unable to establish the relationship", this is why I had a go at doing this myself directly with the underwriter, because the FOS take so much time, even longer than when they deal with a ppi complaint via broker.

I was fortunate with mine, but not everyone are, its about careful wording when writing to them, as we cannot exactly treat the complaint directly to them, but to make it clear that you are aware of the relationship held they have with the broker/lender and have part liabilities of the insurance.

I did do a write up some time ago on here....:tinysmile_twink_t2:

A common misconception with this issue is that sec 56 of the Consumer Credit Act applies.

                      See post #2 http://www.consumeractiongroup.co.uk...-Viewing)-nbsp

                      It doesn't. See attached.

''6. Different payment protection products are subject to different regulatory regimes. Table 1 summarises the FSA’s and the OFT’s current regulatory responsibilities. A key distinction between products is whether or not they involve insurance. Insurance products are regulated under the Financial Services and Markets Act 2000 (FSMA) even if the linked credit agreement is regulated under the Consumer Credit Act 1974 (CCA) or is unregulated''

Can anyone help just had rejection letter from Aviva inviting me to go to ombusman but basically saying I would be wasting my time. I was rejected in my ppi claim with Paragon and Greenhill can anyone advise what I might try next? Or is this the end of the road.

Can you post or type the reasons they gave for rejecting it?
