  • Lloyds/Cardiff Pinacle - who is responsible?

    Hi everyone,

This is my first post here so a quick *hello* to you all. I've found the information on here very useful and wondered whether anyone could advise me?

I took out a car loan with Black Horse (Lloyds) in 2004. I was advised that I had to take out PPI or I wouldn't qualify for the loan. I put a complaint into Lloyds on this basis (I have successfully reclaimed on another, newer Lloyds loan on this basis) who have replied with this statement:

'I have investigated this further for you and can confirm that this policy would have been sold by Cardiff Pinnacle Insurance. Therefore your PPI Complaint would need to be sent to Cardiff Pinnacle Insurance.

Blackhorse did not commence the selling of these policies until 14th January 2005.'

My paperwork for this PPI is from Pinnacle Insurance. However, because the PPI was sold to me by a Lloyds employee when I was arranging my loan, should it not in fact be Lloyds looking at this complaint? Should I now approach Pinnacle insurance (who I imagine with direct me back to Lloyds) or should I continue to badger Lloyds?

    Any advice greatly appreciated!

    k.

    Hi and welcome to LB!

good to have you on board

There are a few PPI specialists here, and I'm sure they will be able to help you with your fight, in the meantime.

      Hi and welcome

What I would do then is forward a "copy" of the letter you received from BH and send to Cardiff Pinnacle, see what they have to say, if they come back and say no they are not responsible, send the letter you receive "copy" to Lloyds and tell them you want this matter looked into because as it was advised by a Lloyds employee and not Pinnacle, then it is them that is liable.

Good luck, let us know how you get on, cheers.

        Hi Kitty Cash,

As the Lloyds salesperson marketed the loan to you then it is Lloyds who have potentially mis-sold the contract to you.

It is misleading for Lloyds to reply the contract was sold by a Pinnacle salesperson.

        good luck!

Thanks everyone - really useful replies!

All of my correspondence with Lloyds regarding re-claiming my PPI has been done (excluding the first FOS questionnaire) via email - very convenient but I think perhaps I should print these out and have 'hard copies' as it were. My gut feeling was that the issue lies with Lloyds as they did the selling of the product.

Does anyone have any experience of trying to argue this stance? Any further tips on how to re approach it with Lloyds, what to say etc?

          Thanks again!

I have a huge dispute with black horse at the moment one which is PPI they refused to pay out in the first instance, but I was very persistant and in the end did get my PPI claim won (over 2 weeks still waiting for the cash) I have the e mail address for the company director if you so wish it, the more people sending him snotty e mails about thier company the more likely we would get things done.

Messimo - that would be useful thank you. It took me 6 months and countless emails to get them to change their mind (from rejection to success!) on another claim I have with them and I refuse to give up on this one!
