    Hi all,

    Have just sent off a claim for mis-sold ppi and have a few questions i would be grateful if any one could answer?

    1. I sent a letter requesting Terms and conditions for time of credit card application (2001) they have taken the cheque payment of £1 but i have yet to receive documents! i have chased this but am getting passed pillar to post...... any ideas?

    2. I have now sent a letter with the consumer questionnaire requesting a full refund of ppi, if granted am i likely to receive a backdated payment from the issue of the card (2001)?? i keep seeing mention of only a 6 years previous payment!

    3. And lastly has anyone had any luck with getting an SAR request for dates further back than 6 years previous from hsbc, i would like to apply for this but would want it dated back to 2001??

    Any help much appreciated

    Hi and welcome

    They should provide you with the CCA by 12 to 14 days, if this time have passed, give them a call and question this, and tell them you are aware they have accepted and debited the payment.

    It may vary from one business to the other, but hopefully they will go all the way back, if they do not hold any info prior to the 6 years, they may ask you if you are able to provide anything further so that they can refund all the way.

    Yes, with my Lloyds SAR I received data going back all the way from the 90's, again though it may differ from one business/bank to the other.

      The terms and conditions request was sent 21st may with the payment taken on the 29th may, i have since made several phone calls and sent emails with no joy! some have said it might be too far back as the 6 year rule and tried to refund the money, i however refused this and said i shall continue to request it. Any ideas of the next step to take?

      I had a bit of luck today when i remembered i once requested my entire current account history back in 2006, these statements show minimum payments to my credit card account that i set up as a direct debit..... this should be proof of how much my balance was each month as the minimum payment is a percentage of the overall balance. It might be a long shot but should i be successful in my claim maybe that will count..... what do you think?

      I will still request an SAR soon and that should provide me with at least statements back meet my account statements.... any recommendations on where i can find a decent SAR template??

        Your very welcome.

        I would then now if you've not done so yet, email the Chief Executive officer (CEO of the business, email address below, if that fails, some local MP's can be very helpful.

        Dear Sir/Madam

        Please send me all data that your company holds relating to my entire account history. Please include details of all transactions, and a copy of the original contract by which this account is/was governed at the time it was opened including all amendments made to the contract terms since opening the account.

        I would also like a schedule of all charges & interest applied to my account(s) including details of any instances that required manual intervention. If you are unable to provide this specific information, copy statements will suffice.


        All data, including data held on a microfiche must be provided within a reasonable timescale, a maximum of 40 days.


        In light of all the recent publicity regards the reclaiming of bank charges, some Banks appear to now only be providing a breakdown of charges in response to all and any Data requests. For the avoidance of doubt I do actually require all information held by yourselves.

        It seems a lot of banks are also wrongly interpreting the Data Protection Act (DPA) 1998 as a requirement to only disclose six years worth of personal data, and this is also wholly wrong. The DPA clearly states that all information held must be disclosed and it has no correlation to the Limitation act 1980 at all. If you no longer hold data beyond 6 years however, I would like a signed declaration from your data controller and a copy of all documents pertaining to its proper disposal.

        Whilst not exhaustive and for the avoidance of doubt I shall list what I require:

        * Full copies of all contracts that exist between myself and your organisation; including copies of any documents you hold in support of same.

        * Copies of all statements relating to the above accounts.

        * Copies of all correspondence, including all letters, faxes, emails and memos sent and received between ourselves, and any other third party in relation to any of the above accounts.

        * Copies of any telephone recordings and/or transcripts of these recordings as well as any logs or journals that relate to them.

        * Copies of all documents which include any of my personal information including copies of any contracts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

        * Full details and copies of any documents upon which you relied when you have provided my personal or financial information to any individual, organisation or third party.

        * Full copies or transcripts of any computer logs or database records kept in relation to myself or in relation to my financial or personal information.

        *Details of all systems you currently have in place to ensure my personal or financial information is kept securely, including details of those officers who currently have control of same, and at the time it was held or provided to a third party.

        * Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, reason for deletion, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

        I enclose the maximum statutory fee of £10.

        You have 40 days to comply with this request.

        If you fail to comply fully I shall enter a formal complaint with the Information Commissioners Office which could result in a fine and prosecution.

          Hi,

          I have an update for you on my claim

          The claim was partially successful as they have offered me a sum of money as a refund, but they have only offered it going back to 2005 and the card was taken out in 2001!

          Can i contact them and ask them to revise the offer to cover the whole term of account as they have sent me a 'final decision letter' or would i have to go direct to the FOS?

          as mentioned a few months ago i have evidence but it is only in the form of current account payments to the credit card account showing monthly minimum payments, but as these are a % of the total balance each month it can be worked out. What do you think??

            I would as a first step phone them. Explain to them that you have evidence of the payments made from 2001 to 2005 and ask if they would amend their offer if you provide the evidence.

            This will give you a useful indication before you have to make a decision about either accepting the offer as it stands or sending the matter to the FOS
