I read this I am not sure if it menas you can sue or not, what do you think?

If the FOS say you can enforce it in the courts i would write to the defendant formally giving then 7 days to settle.

When they don't respond, and i bet they don't, send them a LBA giving further seven days then take them to court.

When you take them to court ask the court for interest on top Sec 69 8% plus costs.

You need to write, phone calls will probably not get any response. You also need to explain to them what you will do IE take them t court to enforce.

If it goes to court, and they don't pay then you can instruct bailiffs. The court bailiffs may or may not get a result, however these is a mechanism to instruct private bailiffs if needs be and they will get a result if its possible and they add further costs to the defendant.

We had attempted to get in touch with nemo one last time today and was then just told there was a message that the complaints coordinator will email back with some feedback regarding the settlement.

The email was finally sent and stated that Nemo's solicitors have sent a letter to the financial ombudsman yesterday, nemo themselves does not know what the letter entails and that they will get back to us when they hear !.

The final decision was in October, and is now binding between us and the company, so why on earth have their solicitors wrote to the financial ombudman who was dealing with our complaint and have agreed by both provisional and official decision it was mis sold ??

Now to me they are using all they can in their power to hold paying this out !
Wonder what other reason they have to write to them ?

Hiya, I would ring your case handler first thing Monday ( i guess they don't work on a sat) and DEMAND they tell you whats in that letter (they should have it by then). Request that FOS take further legal action against Nemo if they can, If not an LBA to Nemo, as suggested. It may be your only option.
But just wait till you get some answers from FOS.

LOL, just found this now, OMG 3 years ago in 2007, when i first signed up and did not have a clue on ppi then.....

Anyway they finally paid out on this in Jan/Feb 2008.
