        Re: life/critical illness

Thanks for posting that up Kate.

Just a suggestion then, I know it's a right pain, but if you want to send the one I posted above, on above post, or the one below is up to you, as they have failed to comply.
I would make a point at the same time, the account is still active and has been for the last 25 years or so and they should comply to the Data protection act (DPA), but ask them to deal with this by 7 to 14 days maximum, (enclose the payment again, so it does not stall any further) you could though as well contact the Information Commissioners Office (ICO) for further advice before you do, see what they also suggest as well.

        http://www.ico.gov.uk/Global/contact.aspx
        LETTER BEFORE ACTION

Relating to Section 7 of the Data Protection Act 1998.

        (Date)

        Dear Sir/Madam

        Account Number: xxxxxxxx

You will be aware that on **/**/** (date you sent SAR) I sent you a Subject Access Request under the Data Protection Act 1998. This was sent recorded delivery and was delivered to you on **/**/** (date it was delivered to them) therefore on the **/**/** (date when 40 days expired) you should have provided me with all personal data relating to me as a data subject. You have failed to comply with my Data Protection Act Subject Access Request and therefore I have made an official complaint with the Information Commisioners Office and no doubt you will be hearing from them in due course.

If you do not comply within the next 7 (or 14 days maximum) days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.

I trust this clarifies my position.

        Yours faithfully

            Re: life/critical illness

I am really not too certain on that one to be honest Kate, as they have so many addresses lol, but if you send to the Main head office of Barclays, they should forward your request to the relevent department that deals with these matters.

I assumed it was this one below, but if you contact Barclays direct, ask them to clarify, just tell them you are sending a letter to request for data request and if they will be able to confirm.

                  Re: life/critical illness

Not having much look. nationwide have got back to us regarding the ppi, but are not proceeding any further as they say according to the paperwork my partner took out unemployment cover only and declined accident and sickness so he must on known what he was taking on. As he was in employment at the time he took it out it would of paid out if he had lost his job.

Aww so sorry to hear that Kate.
                    Was it the final decision?

The point here is, even if they did add it, hubby may not have wanted their's and if they made him take it out with them, or add it automatically without hubby agreeing, then that is wrong that they do that.
You can still try fighting this, or if you've been give the final decision, complain to the Financial ombudsman service (FOS). x

the letter says if we are not happy with the decision then feel free to phone them, just wondering whether its worth going to a ppi company and let them fight it for us?

                        Hi Kate

Personally I would keep on yourself, they do tend to try fobbing off with excuses at the beginning, you have to stand your ground and keep at them.

If you do use a company, please be aware of the charges that can come along with it, and make sure they are legit through the management claims (ministry of justice (MOJ).

The main of us get the same responses at first and it can also be the same for CMC's as well, but in my personal view, do not give in, show them you will not give in that easy x

                            Re: life/critical illness

Di, this is the letter we have composed re the ppi, does it sound ok
Whilst I thank you for your letterof xxx 2012 I am writing to say I am dissatisfied with your response.

As you state in your letter I completed a DBS Additional Advance application inJuly 2001 for which I purchased an MPPI policy for unemployment cover only.

I reiterate that during the sales process, I attempted to explain that I didnot require any cover as I was adequately protected through my employment at thetime, but was told to gain the advance I had to have some level of cover. Asyou have stated in your letter, I turned down 2 of the 3 options this being thecheapest available so that I could then obtain the advance. It was neverexplained that by adding the PPI premium to the loan amount, it would incurinterest over the whole term of the loan. Neither, if I had wanted to, was Igiven the option to shop around for this cover.

Clearly I was aware of thecommitment of taking out a mortgage and the consequences of failing to meetmortgage payments but was more than happy with the unemployment package I would have offered me and so this was of no great concern to me.

This PPI policy was without doubtsurplus to my requirements.

I would appreciate if you couldforward me copies of the documentation you hold in respect of my applicationfor the Further Advance and PPI where I have requested that the cover be addedto my account.

When I completed the mortgage in 1995 I never took out an MPPI policy as thiswas a joint mortgage and my wife at the time was self employed, and we wereboth aware this would not have been appropriate.

I look forward to your further reply and hope we can come to a more favourableoutcome, otherwise I shall have no option but to contact the FinancialOmbudsman Service to investigate my complaint and I will not hesitate in takingthe matter to the Courts if so required.

                              Hiya

Yes that is fab Kate, keep a copy of this as well, just in case you need to complain to the FOS, and at the bottom of the letter, request they write back within say 14 or 21 days.
                              Excellent stuff.

                              Good luck.
