I have been trying to do my own PPI claim and have just had a letter back stating HFC Bank are refuting the claim as Promise Finance were the brokers not them. I have now been told that Promise Finance went into liquidisation in 2008. Is this the end of the line as far as my PPI claim goes?

    Hi there

What year did you take out the loan.

If from 14 Jan 2005, you maybe able to make reclaim thorugh the Financial compensation Scheme (FSCS).

A business who I had taken out a loan with back in 2005 went down under and I made a successful reclaim through the above organisation, but you will need to contact them to ask if the business are listed with them (as they do not confirm all on their website), and they may already be in default, if this is the case you will not be waiting too long for the case to be resolved.

If the business are just waiting to go into default, then it will take a little longer, but you can still arrange for the FSCS to send you out a claim form.

Contact the FSCS below, I would give them a ring instead of an email though, because they have backlogs of emails to get through normally.

    http://www.fscs.org.uk/contact-us/

If the loan was taken out before that of 2005 and if your unable to make a reclaim through the FSCS, contact the Financial ombudsman service (FOS) explain your predicament and they may suggest the insurer/underwriter as another avenue to take.

Do try the FSCS first and take it from there.

If you can make a reclaim via FSCS, they will arrange to send you a form, you then send them any "copies" of paperwork you have, it does not matter if the paperwork is that of the lenders, if you've not got any from the broker, because they have ways of doing this work and linking them up.

    Hope this helps, good luck.

Edited to check FSCS default list and it appears Promise Finance are in default, so if your able to make a claim through FSCS, it should not take so long as if you were waiting for the business to go into default.

However, this will also depend if you taken out the loan after the date 14 Jan 2005 as well.

Some info as copied and pasted from the FSCS site.

    Search for companies in default

You can search our database to see if the firm you are making enquiries about has already been declared in default by the FSCS. This means that the FSCS is satisfied that it is unable, or likely to be unable, to pay claims against it. This opens the way for the firm's customers to make a claim for compensation to us.
Find out if your company is listed in our database

    Company name:
    • Promise Finance Limited (formerly Promise Solutions Limited)

Declared in default 27th October 2009

Hi there, it was November 2006 when I took out. I have been told that a company called Deloitte are now dealing with any matters relating to Promise Finance, would you contact them or go to the other which you have mentioned?

          Hi MrsM83,
De Loitte le Touch were the Admistrators for Promise Finance Ltd
.......Promise Solutions Ltd bought Promise Finance Ltd off the administrator for £10,000.
The Directors of Promise Finance Ltd and Promide Solutions Ltd are all the same people...........another con that goes on in the financial world......I would also contact The MD of Promise Solutions Ltd and tell him that you hold HIM PERSONALLY responsible for the miss selling of your PPI ...as he was also MD of Promise Finance Ltd see what he says to that.
His name is Mr Stephen Walker

haha funny you mentioned that because I rang Promise Solutions and told the girl I had companies house in-front of me stating they are linked to Promise Finance, she was adamant they weren't, then said hang on I will ask my manager" and then the phone went dead! Hmmmmmm, crafty.

              Hi again,
Take a look at the "Promise" thread I started......I am involved in fighting this shower although I have not done too mch work on it as of late they are next ......I have another claim going on that is taking most of my time........you might find some info you can use on that thread...I've caused a few waves there, click on this below,

Take a special look at post 23 and onwards for your benefit
              http://www.legalbeagles.info/forums/...ad.php?t=29704
Copied this below from that thread......this shows they told you lies when they said they had nothing to do with Promise Finance.........they are still using that name as a trading name, or were up till the end of last year, haven'nt checked their licence lately but I will right now

Yep still using it ...........little fibbers aren't they all?
              Sparkie

Here is the ICO data controllers licence held by Promise Solutions…………it shows quite clearly that any information given to Promise Finance and any information held by Promise Finance will also be held by Promise Solutions as Promise Finance obtained data and information under Promise Solutions ICO licence…..that is why Promise Solutions Ltd is stamped all over our documents …drivers licence, bank statements utility bills and copied credit file.

This I believe shows that in correspondence Mr Walker CEO of Solutions is not quite telling me the truth…
They are still using Promise Finance as a trading name

Also note they have changed their registered office address
Question is …I wonder why??? Is this to “Lose” certain paper documents??

                Re: Promise Finance

I rang back and they actually asked me if I wanted them to do my PPI claim for me?

They didn't put up much of a fight when I said "Well no, considering your the same company I would not like for you to do it for me!"

                What a joke!

deloitte have wrote back to me as they are handling the ppi claims

they are requesting the original policy document which i do not have

they also want the original finance agreement if the ppi was added to the loan, which i dont have

they have said that the firm who sold me the policy are unlikely to be the insurer.

my loan was with HFC bank - it was arranged by Promise Finance and I have been told there WAS ppi on the loan. How do I get the documentation they require if Promise Finance have gone bust? I have already provided them with the photocopy I received from HFC bank which is Promise Finances agreement but this must not be what they are after.

                    Hiya

The lender will have a copy of your application/agreement, even though the broker are responsible, you will find the main of the paperwork will be that of the lenders, so in your case HFC, if you ask them for documentation of the loan, you can send Deloittes them (copies).

If a broker is no longer active which is why your going to deloittes, then it will be difficult to get any paperwork from them, but the lender will have them, and deloittes will be aware of that, of the relationship of both broker to lender.

                    Hope that helps.
When I made a reclaim through the FSCS I sent lenders paperwork. x

thanks, do you have any suggestions of what to write in the letter to HFC? Or should I just include a copy of Deloittes letter?

                        Hiya

Yes, write and explain you have a case being dealt with by The Financial Compensation scheme (FSCS) & Deloittes via Promise Finance, and they are requesting for paperwork for your loan arranged by Promise Finance, I would send them a copy of the letter you received from Deloittes, and if they will post you the copy of the Agreement plus if they also have a copy of the application form which will help your case.
Also ask them to contact you direct if any problems, but tell them you require the details for as soon as possible.
                        That should be fine.

They may ask you to pay £1 cheque or postal order for the copy of the agreement, so as this is the cost for this request, maybe you should enclose this and make it clear that you have enclosed the appropriate payment for the request of the Credit Agreement, there therefore have 14 days to send.

                          how does this sound:

As you are aware from previous correspondence to yourselves I am in dispute with regards to some PPI that was added to a loan I had with yourselves.
I now have a case being dealt with by The Financial Compensation scheme (FSCS) & Deloittes via Promise Finance, and they are requesting for paperwork for my loan arranged by Promise Finance.
I have included a copy of the letter from them so you can see exactly what they are asking for.
As Promise Finance are no longer trading I am unable to get the information from them directly, therefore, could you post me the copy of the agreement you received, plus if you have it, a copy of the application form which was originally submitted to you to help my case.
From the letter they are also asking for account numbers for the loan and also for the PPI, if you have these and could provide them also it would be greatly appreciated.
You can contact me directly if there are any problems.
I require the details for this as soon as possible and appreciate your prompt co-operation on this matter.
