  • re claimed ppi

    hi
i would appreciate your help on the 17th october this year i recieved a letter from RBS stating that they were willing to refund me £3130.00p and that i should recieve a cheque within 28 days, if my credit card account was not active this credit card account has not been active for over 3 yrs well guess what i dont believe what RBS have done because i had a credit card with them i had a ppi with it to cover payments should i needed to well i was self employed at the time and only found out that the ppi was worth less for self employed people so because i could not make a claim on the ppi i defaulted and RBS handed my account to a bebt collecting agency who contacted me and asked if we could come to some arrangment to pay the debt of i aggreed and started to make regular payments of £20.00 per month and then increased this to £30.00p per month after a review and this is still the case today december 2011 i had a credit limit on the card of £7400.00p and never exceeded this amount in fact my account is a lot lower now ,.
when i phoned the banks ppi team at Rsb in Manchester i was told that the refund had been paid direct to my credit card in november off this year i was not even informed of this at all surley it is not the banks decision to make is it after all they miss sold the ppi in the first place surley it is my decision should i wish to pay the credit card /or any other personal debt i may have after all this account has not been active now for over 3 yrs i would like to have some input as to what to do next to get this refund paid to me.
    thank you for your assistance

    Re: re claimed ppi

As i understand it where there are arrears on the account in question they have the right to off-set any PPI settlement against the arrears.

Despite the fact you had not exceeded the credit limit i assume that you must have defaulted on payments for your credit card debt to be passed to a debt collection agency.

Please correct me if my assumption is wrong.

In any event i think you should probably just accept that your debt has been reduced significantly and move on.

Alternatively contact the FOS and see if they believe the lender is in the wrong.

      Re: re claimed PPI

I had a similar experience with a Sainsbury/Bank of Scotland account.
I had been on a payment plan and did the PPI through the FOS.
I got the standard letter eventually) regarding that it had been upheld and that any outstanding amount would be paid and that I would receive the remainder.
However, without giving me time to respond, they send me the full amount but about three weeks ago I started getting mail from Blair Oliver Scott trying to collect on the "remainder"
Do I have to pay them? It appears to be an error on the part of the bank but can i now say its settled? xxDT
