    I'm new to the forum and would like some advice if possible.
    I recently was awarded a payment of £2800 from my bank after claiming for misold ppi .

    The co who I asked to reclaim this for me are called the claims guys and i believe that they initially made false promises to get me to sign up with them.

    On two occasions they told me that if I went with them they would have it settled in six weeks.
    This was back in January and i now believe that at that time they knew that this promise wouldn't be kept.

    If i was given the correct information at the time i would have made the claim myself and only chose to go with them because of the time promise.

    I have refused to pay their invoice and they are now phoning me on a weekly basis and have told me I could incur additional charges if not payed straight away and have said i will end up with a CCJ.

    I would like anybodys views on this.

    You should have made the claim yourself!

    At the end of the day, there will always be a bill to be paid to the cmc.

    Why, consumers choose to use them I have no idea, other than ignorance?

    Complicated PPI reclaim cases are of course exempt from the above view.

          Did they specify within which six weeks?

          Even if they did - which I doubt - that representation should surely mean that time was the essence of the contract. Had their client understood that the claim mismanagement company would take so long about it, they would surely have gone elsewhere, or made the claim themselves.

            DS at post #3 has given the only sensible advice so far, post up any paperwork you have and then we can take it from there. You aren't the only one to get taken in by these types, and I'm sure you won't be the last.

            Personally I think niaive would have been a better adjective to have used than ignorant, but that's just me.

              post up any agreements and T&C's that go with them so we can have a look to see what can be done to help you

              I have sent one of these companies packing already for one of my mates but it depends what is written and how it's written on the agreement and T&C's

                Please forgive the amateur theatrics. The rogue CMC's vastly outnumber the decent ones, and they abso-bloody THRIVE on good people like yourself, who have better stuff to be doing with their time than D.I.Y. So, you get a bloke in to install the power shower, and he rips you off. Plumbers.....almost as honest as bankers !!!

                Dammit. You admitted your mistake. THAT is a big credit to ya, in my humble - yet still male - opinion !!!

                Maybe we should take it as a compliment that you have now turned to an advisory forum with this. Take the @$$-kicking that you're now getting, and pick up the DIY leaflets at the checkout. I did the same 5 years ago - and I'm STILL here getting my @$$ kicked !!!

                What you now have to do is grasp the idea that we will HELP you as much as we can, but we do NOT do the work for you. THAT's why we don't ask for money up front - just.....maybe......a little contribution if we get you some dosh back. That's the deal, in essence.

                You WILL NOT get ripped off, here. But you WILL have to get your hands dirty, I'm afraid.

                Here.....YOU get to choose. You gonna rock.....or you gonna roll ?

                      Generally on the Banks web sites regarding claiming PPI which I have seen on a couple of them they have posted a warning that individuals can claim their PPI refunds themselves without the need to use a CMC.

                      However, it was your choice to use that CMC and I know how pursussive they can be on their sales pitches and as Debt Star and others have pointed out you need to post up here those all important T&C's which you would have agreed to by signing.

                        The Terms and Conditions may not be quite as important as the claim mismanagement company might pretend, if they had stated before the client signed up that their claim would take six weeks or less before the money was paid. Such a statement would surely be an inducement for the client to use their company rather than any other and hence it could contravene the CPUTR as well as being a gross misrepresentation; I would therefore contend that, under the Misrepresentation Act 1967 (link) the contract between the client and the company should be rescinded ab initio, as if it had never been made.

                          Hello and thanks for the advice ,i have looked and don't have any t&c or paperwork relating to this.
                          They do not have the money it was paid to me and they are trying to get just over a thousand pounds off me as their fee!
                          Below is a copy of the email i sent to them.

                          Good morning
                          I'm writing to let you know that I'm disputing the fee that you have invoiced me on 03/08/11.

                          I have been waiting for advice on this matter as explained to your representative in our telephone conversation on 03/08/11.

                          The reason im disputing the charge is that the only reason I authorised you to work on my behalf with this claim was the promise given by your employees on two occasions that if I let you reclaim on my behalf you could achieve a settlement and indeed payment within six weeks.

                          I now know that this claim was infact untrue and as it was the only factor on which I decided to let you represent me on this think you have misold your services to me by giving unnobtainable promises in the first instance.

                            Have they by any chance sent you any letters THREATENING legal action

                            ie.
                            saying

                            if you don't pay they will take you to court

                            If they have (and ONLY if they have threatened legal action) then I would be inclined to send them a CPR letter and see if you get a copy of the agreement and T&C's
