    I am at my wits end with the ongoing handling of my claim from Welcome Finance, regarding mis-sold PPI. To briefly summarise, my claim was handled by a Claims Compensatory Compay (Claims Advisory Group), this was started over two years ago. In January 2011 I received news that my claim for compensation had been successful and that judgement in my favour had been made by the Financial Ombudsman Service (I have the judgement documents and case number) and that an offer of in £4033 was to be made by Welcome Finance, I received a breakdown from Welcome of the compensation breakdown and what my new payments would be minus PPI, although they did not enclose acceptance forms. Weeks went by and no further news was forthcoming from Welcome. At the end of February I learnt as many others had done that Welcome had defaulted and all claims had to be resubmitted to the FSCS as the previous claims were null and void, which I duly did. Months have gone by and still no result, last week I received a letter from Welcome stating that as my claim was in the jurisdiction of the FOS, they would not be considering it any further, after many phone calls I am left with considering the option of withholding my payments until this situation is resolved, does anyone know where I will stand if I pursue this drastic action. I did request in March that they cancel the ppi forthwith and received a reply that they would do so, but the monthly loan repayments would remain the same how can this be. I also notice that Welcome are corresponding using photocopied letterheaded paper, seems unusual to me. Any advice would be gratefully received

    If they are still taking the same monthly amount this is clearly wrong. I'd be inclined to SAR them so you can see exactly what information they have about you. I'd also say that there is a clear dispute here, not only over the ppi as they had not paid out the previous claim despite it being 2 years old, but they appear to be continuing to taking payments for a ppi policy they say they have cancelled. I would then say that as the account is in a formal dispute, you are witholding payment until such time as the dispute is resolved.

    This I think would put you on a stronger wicket than just stopping payments as they would have every reason to come after you for the debt. If it is in a formal dispute, you have a much stronger case.

    You may know that a SAR costs £10 and they have 40 calendar days in which to respond with the information.

    TBH, Welcome / Cattles are in such a mess at the moment I thin they're just trying to get as much cash in from people as possible before they finally close for good.

        The original loan was taken out in January 2007, I have complaints relating to previous loans prior to this, it sounds sensible to write and inform them that I shall be withholding my payments as I intend to dispute my account. Please pardon my ingnorance but what is SAR is it a formal procedure for complaints.

              Dear Sir/Madam
              Data Protection Act 1998 Subject Access Request

              Please would you kindly provide full and complete copies of any and all data you hold which relates to me and my entire history with your company. I have enclosed the statutory maximum of £10.

              For the avoidance of doubt, take note that the enclosed cheque/Postal Order is payment for the fee relating to my Subject Access Request only and not a payment of any other kind or to be used for any other purpose. If you do not require a fee in order to process my Subject Access Request then kindly return or destroy my cheque / PO.

              For your convenience I have detailed below a list of what I require, although this is not an exhaustive list by any means and is just an example of some of the information I require with regard to any accounts I may have had or may still have with your company.

              1. Computer screen notes relating to the conduct of my account
              2. Computer screen notes relating to transactions that have gone through my account
              3. Internal messages or notes relating to the conduct of my account
              4. Internal messages or notes relating to transactions that have gone through my account
              5. Recordings of any telephone conversations, whether internal or external, relating to my account
              6. Copies of any e-mail's, or other electronic communications, whether internal or external, relating my account
              7. Copies of letters relating to my account
              8. All information relating to litigation or pre-litigation that has taken place on my account
              9. A detailed statement of account showing a breakdown of all costs charged, showing in each case the reason for the cost and the actual cost against that item
              10. Copies of all reviews conducted relating to my account
              11. Copies of all other paperwork relating to my account.

              12. Copies of any and all documentation issued to me or left at my property regarding my account
              I trust that the above is clear and should you be in any doubt as to your obligations as a Data Controller, then I would advise that you consult your corporate counsel.

              As detailed above, I have enclosed the statutory maximum fee of £10. You have 40 days in which to comply.

              If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one to which all previous correspondence has been issued.

                  Well after nine month persistence, I have finally got my settlement, but never count the chickens until the cheque is in your hand but a good figure nonetheless, moral of the story is Dont give up and keep on their case
