    My view of the ICO is very poor indeed. They are worse than useless.

    So, bearing in mind that they take 9 months to write a crappy letter saying that the lender has breached the DPA but has since put it right and only did so in error bless 'em (the ICO being there to guide and help 'em, bless their cotton socks), my view is to send in a complaint to the ICO as soon as possible. They write back after several months saying at the time you complained the bank wasn't in breach etc but I then reply saying that they STILL haven't responded / or responded in full and at that point the ICO take it up (backed up with evidence in the form of recorded delivery payment slips etc).

    This is just my routine, you'll develop your own. But do keep all recorded deliv bills as they will ask for these (lenders routinely deny receiving SARs and letters from debtors and the ICO are forced to take at face value what the banks tell 'em). So keep the proof of postage mate, at all times.

    To answer your question, 50% of the time I wasn't getting a SAR at all (eg HSBC were woeful) within the time frame and 50% of the time the SAR was incomplete, which of course is where the ICO complaint comes into play as lenders usually do supply a SAR sooner or later, just not an adequate one.

      I don't think there is any kind of template letter to make a complaint to the Information Commissions Office (ICO), but if needs to be you can ring, write or email them.

        It's a good point DS, and a very welcome approach which I think I might just follow. It certainly wont do any harm and at least I will have covered all angels.

        I have kept the receipt for postage of the SAR and also printed off a copy of the "Proof of Receipt" BTW, so there's no way they'll be able to say they've not received it.

                Ok, I have today received a letter back from the Blackhorse Customer Complaints Department which reads as follows:

                I refer to your recent letter.

                I have been undertaking searches of our systems and unfortunately I have not been able to locate an agreement for you with the information you have provided.

                In order that we may comply with your request please provide us a valid agreement number with any further information, for example any previous address that may assist us in locating your details. Once we have located your agreements we will send the information that you have requested.

                Please find enclosed your original request.

                Yours sincerely

                Customer Complaints Team
                So what now? I don't have the agreement numbers for any of the 3 loans and I already provided previous addresses with the original S.A.R.

                They have returned my original request along with the £10 cheque.

                Have I hit a brick wall due to the fact that I don't have any agreement numbers?

                  Sorry if I have or if this have already been mentioned.

                  But do you do online banking?

                  If so and your still with the same bank now, this should allow you to locate accounts on statements as from 2002 and upwards, the account numbers of those loan are normally shown next to the loan monthly repayments.

                  With BH being related to Lloyds, you could call into a local bank and they should try checking them out for you.
                  Its just a suggestion but it may work.

                  And what I did a week or so ago was actually email lloyds and asked them to provide me with the loan account numbers as from my very first loans in the mid 90's, and they did so by just me enclosing my bank account number, full name details, and my last address etc.

                  They could not locate the agreements, but did confirm PPI was added, so I am on the way of making reclaims on these.

                    Yes I do still have the same account the dd payments for the loan were made from, I still have all the paper statements but the dd payments show no reference with regards to the agreement numbers.
                    I have also gone into the branch to see if they could help but I was told that their records do not go back far enough.

                    Is there any other way of me finding out the loan agreement numbers?

                        Initial loan was taken out in November 2001

                        Bank credited with £1000 on 15/11/2001 – this will not include the PPI

                        I then made 8 monthly payments by DD of £67.94

                        I then re-financed in August 2002

                        Bank credited with £688.48 on 12/08/2002 – again this will note include the PPI

                        From here I only made 1 months payment by DD of £77.99

                        I re-financed again in December 2002

                        Bank credited with £2979.28 on 03/12/2002 – once again this will not include the PPI

                        I then made 23 monthly payments by DD of £201.07

                        I then settled the balance when I took out my mortgage, not totally sure what the settlement figure was though.

                          If you settled this with the mortgage, then its possible they may have hold of the account details, just a thought but another way of checking.

                          However, I did read that someone had made a reclaim without the account numbers and given all the details on the loan in order to track it down, and they also succeeded.

                            If I was to do a SAR on the account the dd's were paid from would this be likely to show the loan agreement numbers?

                            How far back does the SAR give information for??

                              It's quite possible, but the normal is that is the last 6 years, yet again some banks are more lenient than others.
                              The data I received on a SAR I requested for late last year, they supplied info going way back to the late 90's.
