Should I just do a SAR??

I might as well request everything together as the address they have given me is the Customer Accounting address in Cardiff.

Personally in my opinion yes, a full SAR will be helpful.

The letter they are practically asking you to send is that of a SAR by the seems of it, and with this one you enclose £10 cheque or postal order, they then have 40 calendar days to comply.
This way they should send all they still hold on the account/archives etc.

      3, 3rd December 2002

Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:

      - A complete list of all transactions or statements relating to ALL of my Loan Accounts with your organization.

Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

-Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.

I enclose a cheque in the sum of £10 to cover your fee.

        Yes that's fine.

I would also post it by signed for recorded delivery, so you have proof of posting, and you can also check the status of delivery via Track & Trace - Royal Mail Website.

        Good luck.

If I was to send a cheque to send a cheque to lloyds I would make it payable to "Lloyds TSB Bank PLC"

Re: PPI claim against Black Horse Finance - Where do I start??

Hi Deller old pal - good to see you again. Yeah, I'm still around - annoying peeps and collecting bruises. Been taking a break myself lately, but always happy to help an old compadré if I can.

A quick point if you are sending a DSAR. Remember that this is a request for any and ALL data held on YOU, the Data Subject. Therefore, it may be important to make sure that the request lists ALL names and addresses that pertain to you overc the years, as it YOUR identity that is the primary search criterion. Any other info you can provide to assist with the search is also useful though, of course.

Finding the relevant statements is a great help, If you can find the loan agreements, or obtain copies via the DSAR, then that would be a clincher I reckon, as we have to try and find what amounts of PPI you were charged.

Another argument that you may need to be prepared for is the Limitation Act, as I think they will probably try to use that to hide behind.

Regarding Contractual Interest, I still believe that 8% SI is unfairly low rate, and that claiming a higher rate of Compensatory interest is worth considering - BUT this doesn't carry the backing of the FOS. So, if you are thinking of claiming CI - or a higher rate than 8% SI - then you will need to be ready to go via the Court route.
