    Hello

    Just an update on my fight with the Natwest, Successfuly reclaimed back over £7,000 in ppi on a loan taken out in 2001.

    I have just sent my prelim for the 3 previous loans I had with them, comes to an amazing amount, So fingers crossed.

    I am also having a bit of a dispute regarding non-compliance of information and no credit agreements. I love it. Oh and I bet they love me:carrot:

    You wont remember I know but I posted some 9 months ago OTR about my sister and Barclays she went the Ombudsman way and she should here the outcome this week post permitting.
    When I get the outcome I will give you as much info as i can. Enaid xx

        Hello,

        Have now achieved a Mexican standoff with the Nasty west. They have defaulted me because I stopped paying them as the account is in clear legal dispute.

        Breach of the dpa, failure to comply with me SAR

        Breach of the cca no credit agreements
        Failure to send a default notice

        Breach of the OFT Debt collection guidence guidence.

        Defaulting the account whilst the in clear legal dispute.
        Passing of info to third party.

        They refuse to look into my claim for the application of mis-sold ppi on the three previous loans.

        God to I hate them.

        I have been sitting a little bit on the fence to see which way this will go. Will they take me to court and then I put in a counter claim. Or do I just take them to court.

          What are you going to do?
          Complaint to ICO i would think re the element of breach of DPA,
          Complaint to OFT re breach of debt collection guidelines.
          Complaint to FOS re default notice being served.
          PPI misselling should mean they should provide copies of it, what are the ground of misselling?

          The problem as I see it is that if the paperwork is clean, ie that you were eligible for the cover, they do not have to refund the PPI but they still have to supply the paperwork.

            Thanks for your input

            These ppi policies were mis-sold to me, I was not given any option as to whether It was suitable for my circumstances or not. They were applied, No terms and conditions of the policies were given to me. I do not know to this date who the policies were with.

            There is no information relating to them in the SAR provided to me. They have given me the ppi figures and the refunds, but no mention of the interest they applied to them.

            I feel this is why they cannot locate the credit agreements, because they are a bit dodgy.

              Have they provided original agreements?
              Were you eligible for the cover at the time that they were added to the loan?
              NatWest Insurance Services is likely provider although I will have a look at that shortly.
              If they cannot locate the agreements then they cannot prove that the PPI is clean and therefore should refund.

                Just an update, I have been busy with trying to have a stay lifted on my abbey national penalty charges. Dismissed

                So I can know concentrate back on the nasty. They have not provided me with any information or credit agreements for these previous loans, they state that their databases do not hold this information.

                They have informed me of the loan amount, date of loan, the ppi premium and the amount of ppi refunded when the loan was cancelled for a new one.

                No interest rate
                No information relating to interest charged for loan or ppi.

                They have sent me their final response letter and will not discuss the matter further so my next move will be to issue court proceeding.

                This is were is gets complicated.

                They have defaulted, with out a default notice, me on the loan balance that is outstanding, They have threatened legal proceeding to recover it.

                I have put the account into legal dispute (no credit agreement) and have stopped all payments to them. A decision I did not take lightly, but within my legal rights

                I am more than happy to allow them to keep a portion of the ppi refund, and that they sent me the outstanding balance left and remove the default.Problem solved all round, They will not listen.
