Just had a letter from Cap 1 about my ppi claim "I can confirm that you requested ppi during a telephone conversation 22 August 1997" what next?

Ask them for a copy of the telephone call.

Thanks, it surprised me that they had records going back that far, I don,t even remember the call

capital one only keep call recordings for 6 months but they may have a script from around 2000. cheers

It is all part of the banks defence and they all rely heavily on the 6 yr rule but sec32 of the limitations act tells a different story.

Indeed all banks keep data for a lot longer than 6 yrs they have to, to comply with the money laundering act and the HMRC.

I got agreements and computer screenshots of account history from my bank going right back to 1999.

This in my opinion is where financial regulation is wrong in that there is statutory laws to protect us consumers but banks will not tell us what these are and indeed leaves us to find out ourselves.

But it is ok for them to push the laws across that protects them and considering we are consumers and not savvy with the laws that strikes an imbalance.

Those that find this forum and thus are able to get the tools to fight in most cases will be ok but there are many that cannot do this.

All we can do is rely on each of us to spread the word and with the Government cuts about to be imposed that is even more so.

Give them a call and ask them if they charge for providing the transcipts, one of my friends received some docs free of charge, not the same company though, but otherwise they will possibly suggest to request a SAR.

You should make a FULL subject access request (SAR).
The statutory fee payable is £10;
mark the postal order 'DPA statutory fee only' and;
keep copies.
