    My comment leclerc, was in relation to complex cases;
    taking action against a creditor, can become time barred.

    Not really a problem though if one has a valid counter-claim and;

    IMHO, the FOS take far too long investigating...

      Can I clarify this with you are PT, if there are multiple loans and one is paying off another loan does the first loan become time barred since they are both interconnected?
      None of mine ever did and some of those were inter-connected and some not as I settled early but got redress on all 9 of them going back to March 1999.

      As for AC's comments I agree 2.5 yrs and two wrong offers is far to long and it would not have been settled now had it not been for the excellent work of this forum calculating the right amount and putting those figures to the bank and fos.
      If you think nobody cares if you're alive, try missing a couple of payments.

        its also worth noting that, PPI can lead to irredeemable unenforceability under a regulated agreement

        Look at London North Securities vs Meadows.

            The JR is NOT about the validity of claims but about the FSA's powers & nowt else

              There is a very good chance that PPI was included in that 2nd loan and they do not even know it.

              Lets face most consumer will sign what ever is put under there noses without them reading the small print.

                Yup its quoted in the POC thats what I'm going for refund of all payments made AND damages equivilent to % paid + damages equivilent to contractual compound intrerest for having the 'loan' of the money + 8% CC

                  So based on this and going to the FOS and only getting the return of the premium and a bit of interest at 8% the consumer is missing out big time.:tinysmile_aha_t:
