  • PPI court actions won by the lender

    Apologies if this has been referenced alswewhere on the site, but this is the fiirst time I've seen it and I'd be quite interested in hearing opinions on it

    (Particularly the opinion of PT)

    Seems Black Horse have recently won a number of PPI court claims (including one at appeal) though reading it ity looks like they have been won solely by providing eveidence of procedures that the bank supposedly had in place without particular evidence of it being followed in each debtors individual cases?

    The No Breach of ICOB rules decision was the correct decision IMHO due to the circumstances of the claim.

      Case Law Update - Rosling King September 2009: Banking Update

      Started having a look at stuff and here is a case albeit from 2009 where the lender lost on unfair relationship test.

          Link Financial had a case lost in the tail end of last year due to PPI

          the case is reported on this site as is the judgment

            in your opinion is ICOBS a good basis for a case?

            Also, where in ICOBS does it state breaches are actionable in law?
