    “A case in which Black Horse chose to reject a claim on the payment protection insurance on a second charge mortgage and brought re-possession proceedings instead. A calculation showed that had the couple not taken out the PPI they would never have fallen into arrears in the first place.”

      Theres a good High Court judgment coming soon too, well good from my clients view, not for MBNA

        Fantastic PT cant wait any action from MBNA that results in a win for the consumer is a very good result.

          I feel that the FOS diktat that 'the borrower should be put back into the position they would have been in, had the PPI not been sold' needs to be tested thoroughly, and cases such as this seem to be steps in that direction. I am finding that the terms 'Compensation' and 'Consequential Losses' seem to be converging to the point where the effects of mis-sold PPI are reaching much further than the re-scheduling of a loan. The re-building of shattered lives and marriages is becoming an issue in my experience.

          I believe that we should perhaps distinguish between the mere financial redress that the FOS seems to limit itself to, and the issue of proper compensation for the wider damage inflicted by PPI mis-selling.

            Good post Bill and is my view also my marriage become very rocky indeed and caused heaps of arguments as well as distress and anxiety to the point it put me in hospital with a heart attack.

            If I had known at the time that the FOS would not justly investigate my PPI complaint and instead just go along with what ever the bank said I would of never used that route and instead used a solicitor.

            This would of cost me of course but I believe I would of got a better outcome in a lot quicker time.

              Your circumstances were in mind when I made my comments, PF - thank you, sir.

              It doesn't sit squarely with me, that the FOS are funded by the banks themselves. They are therefore policing their own paymasters. In a perfect society that might work - but in a perfect society, policing would not be necessary anyway, would it ?

              Policing by Consent must surely be better than Policing by Dictation - but when that consent is so arrogantly disregarded, then we have an abuse of power, IMHO. In a true democracy, such an abuse would not survive, because it would not carry the consent of The People.

              We do not give our consent to this, and yet it continues. Are we living in a democracy - or do we start sharpening the blades of Mme. Guillotine ?
