    This is perfectly standard from Cobbetts, nothing to worry about.

    The opinion of Cobbetts as to whether or not you have grounds for a claim will obviously differ from yours and in most cases, that of the court.

        Yesterday I received a letter from Cobbetts which just shows how screwed up they are with all that is going on The letter had the claim number for my ppi claim and attached was a letter that they had sent to the court on August 14th asking for a stay on my charges claim. They said they had sent this letter in August and it had been returned to them. I actually received the letter in August, but as I pointed out to them they keep sending to the wrong addresss ????

        Also in the post this morning. From the Court

        TAKE NOTICE that the ALLOCATION HEARING will take place on 5 February at 10;15 AM at the ------------ County Court When you should attend.

        15 minutes has been allowed for the ALOCATION HEARING ( not by telephone )

        Please Note: This case may be released to another Judge, possibly at a different Court

          Cobbetts are incompetent, it is to be expected. They put their most junior people on this.

          Regarding the Allocation Hearing, this is quite normal and merely means the court would like to meet both parties and hear from you both in order to determine how the case will proceed.

            What would I need with me at this hearing ie a copy of the policy which says

            Self Employed Unemployment claims will be considered if you become bankrupt or you have involuntarily ceased trading due to the financial insolvency of your business and you have notified the Inland Revenue. Temporary cessation of trading or periods of unemployment are not covered.

              It would help to have this, plus everything else that you intend to rely on, but in fact this is not the trial for your case, merely a hearing to establish which track to allocate the claim too.

              It has long been my belief that judges order such hearings to obfuscate matters for the defendant bank in order to force a settlement without using up precious court time.

                    Hi Nattie, sorry I have only just picked up on this. No I have not had any offers from the bank. Re the £21.02 The loan repayments with the cover were £278.50 comprising of MAIN LOAN PAYMENTS 223.69 insurance loan payments 54.81 for a period of 84 months, after they eventually stopped the cover my payment dropped to £244.71 meaning I was still paying £21.02 above the main loan pyments for the balance of the loan period.

                      Found a site during the night called payment care they offered to cover the payment of £223.69 for sickness accident and unemployment for £8.84 Per month I have printed it out and intend to take it to court with me

                        Low and behold post just arrived. Five days before hearing. Letter from CMS Cameron McKenna Our Client: National Westminster Bank PLC Claim No ---------
                        Please note we have been instructed to act for the Defendant in place of its previous solicitors Cobbetts LLP We enclose a copy of Notice of Change of Solicitor which has been filed at Court.
                        Interesting to say the least.

                          wouldn't surprise me if they request next weeks hearing to be set saide to give them more time to get up to speed on the case

                          So you have been refunded the PPI but you are arguing the amount you are now paying towards the principle loan??? is this correct?

                              AI, I think they have refunded the PPI, not to you but onto the loan.Having said that they have not refunded the amount additional to if you had never taken the loan out, ie the £21.02.

                                Thanks Nattie but I have never been told anything by anyone never had a letter or calls from the bank to tell me this. I will go on line now and look at the account
