  • Halifax PPI - please help!

I have had a loan PPI with Halifax from a £12000 loan, I think the PPI is about £3000. How can I get this back, I heard that the loan companies are not refunding everyone they are just delaying it, especially if u are using templates? Is there any truth in this, if not when can I expect my refund?

You first have to establish if the PPI was mis sold before you can reclaim it.
Please read the info on here http://www.legalbeagles.info/forums/...ad.php?t=10645

You can also put your claim through the FOS if indeed it was mis sold that info is here http://www.legalbeagles.info/forums/...ad.php?t=22339

Yes I fall into the category 'ppi was sold as not optional'. should i write to halifax to ask for a refund or just go straight to the ombudsman?

Have a good read of the info I gave you and then you can decide for yourself, the FOS take a long time but then again so do most of the banks etc. If you go through the FOS initially you can then still go the court route if you don't get the result you are after, but you can not do it the other way round.

i think im going to use a company to sort this, it seems too confusing for me. i thought u could just send them a letter

You really don't need a company to do this for you, you can do it yourself. You do however have to understand what you are doing and that is why I asked you to read the info.
As for just sending them a letter, there are letters that you can send should you so wish.

To clarify, it's 40 days on a Subject Access Request
You have to contact the bank first who have 56 days or 8 weeks to provide a final response.
FOS timescales can vary and can take time to resolve. As enaid has said, you don't need a company to do this. The question is whether you want 100% of the money back or 75%? If you want 100% then do it yourself but if not then so be it.

i understand theres a fee for using a company but because i dont know what im doing it seems easier. if i do it myself i just need to get a copy of the loan, send them a letter then they have 8 weeks to reply. is there a letter which i can send to halifax that will speed the process up, or is it generally taking 8 weeks?

They have 8 weeks which is complaint handling maximum timescale to resolve it. Then, and only then, can you go to the FOS.

Have you read the links that enaid has given to you? It contains all the information you need to do it yourself.

I am not a solicitor and there are two letters on post 2 of the thread enaid pointed you to. You send the first one to them then wait for a response, ok?
