    ok finally got round to writing the letter will post it on tues and will kepp tou all updated on what i get back thanks for the help.

      hi guys its been a while but finally got a response from black horse and they have given me everything i requested of them in my sar basically the letter posted above.

      Ok so now i have all the info what is the best way to proceed with this to try and get my ppi money back?

        Have you worked out how much you have paid in PPI now

        Have you checked that the T&Cs dont clash with what you are claiming is missold, ie saying that you may be self employed as some PPI will cover this.

        Have you read through it all?

          the loan got passed onto debt collection agents and i have since paid the balance in full and on my credit aggrement it says total amount payable of ppi is £588.84.

          Here are the reasons i origonally said as why i thought i was miss sold the ppi


          I purchased the above policy from you in July 2004 from Black horse Wigan finance Centre. I now believe I was miss-sold the insurance policy for the following reasons.

          This is due to the fact I was not given the correct information when the policy was sold to me.

          · Your salesperson stated / implied that taking out the policy would assist my credit application.
          · Your salesperson was very pushy in selling me the policy so that I felt I could not say no.
          · Your salesperson did not tell me that the policy was optional and I have since realised that I have alternate insurance cover.
          · Your salesperson did not give me full information on what the policy would and would not cover.
          · I am concerned the sales assistant that sold me the policy has no financial background and the policy was not sold in my best interests.

          i have read through it all Peka but it doesnt really give me any ideas of what else to put.

          any ideas please.

          In the terms and conditions which they have sent me a copy of all be it a very hard copy to read, under the Payment protection plan conditions it states.

          Payment protection plan
          • This clause applies only if an amount has been entered into the second schedule in respect of the cash price of the payment protection plan.
          • we will account to the insurers for the cost of the payment protection plan shown in the second schedule
          • you must ensure that you recieve the details and limitations of each type of payment protection plan specified under the heading PAYMENT PROTECTION PLAN before signing this aggrement
          • if any monies become payable by the insurers such monies shall be payable to us and shall be applied by us in reduction of the outstanding balance on the account.

          the part i have underlined might be of use, i did not recieve any kind of limitations of the ppi although it says make sure you do before signing it.

              few questions

              Have you worked out the figures, In one of your posts you have put £500???? for the ppi premium, have you worked out what they applied in ppi interest yet????

              Have you approached they for repayment yet????????

                this is my origional letter to them.

                Unless you can satisfactory justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statuary interest, the amount a court would award, to be added to each payment made.

                I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the financial ombudsman to investigate my complaint.

                now i still do not know what the total is just that the total amount of ppi was £588.84 not including any intrest as they have not sent me any details of any payments made on the ppi yet.

                    As you have sent an prelim letter, we need to send an LBA

                    I will amend our prelim so tjat you can use it as a LBA

                    I am presuming the Prelim you used is from another site
