  • DCA demanding to visit home

    Hi everyone
Need some avice please, a friend of mine has had a call from a dca "credit resource solution" this afternoon saying they will visit her in the next 48hrs in regards a payday loan. She explained she took this out about 2 years ago but recenntly disputed the amount.

So I was really naughty and phoned them back pretending to be my friend, stating the acount is in dispute and I do not wish them to visit the propery. I will be polite but the gentlyman on the other end was very rude, and suggested the account cant be in dispute, or it wouldnt have been passed to them??? AND he can visit the property. Every time I spoke he spoke over me, so I said if you visit my property i will say exactly the same as i say now and i am goung to put the phoen down. All this time he continued to talk over me Am I correct in saying this, and what should she do if this person knocks on the door, i wish i could be there.
    Any advice please.

These scumbags have NO LEGAL RIGHTS. Should they actually visit your friend then your friend should tell them to F**K Off. If they fail to leave the phone the police (Non emergency line) and report a breach of the peace

They can't visit unless they have made an appointment can they? I guess that's the last thing the OP's friend wants to do.

Although the majority of doorstep visit threats are just empty threats, there is a letter that can be sent specifically revoking the right to visit:

          Dear Sirs

          Ref: xxxxxxxx

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

          Yours faithfully,

Keep a squeezy bottle of water, or a full water pistol by the door.

If the sods send round an oaf, tell him to bugger off.

If he doesn't, squirt water all over the front of his trousers - preferably through the letter-box - so he'll look as if he's wet himself. msl:

If he does call then tell him to go back a different route as it is more scenic.

Just refuse to give details. They'll stay about 20 seconds and then go.
